【摘要】：當前,我國未成年人監(jiān)護面臨需要立法回應的突出問題:未成年人遭受監(jiān)護人侵害問題需要通過完善立法提供保障,留守兒童面臨的監(jiān)護缺失需要通過完善立法填補,新型父母子女關系下的監(jiān)護權歸屬需要通過完善立法加以明確。未成年人監(jiān)護的立法缺失主要包括:立法理念嚴重滯后,體系體例比較散亂,具體規(guī)定存在明顯缺陷。完善未成年人監(jiān)護立法,應實現(xiàn)未成年人監(jiān)護立法理念的轉變,形成完整統(tǒng)一的未成年人監(jiān)護法律體系,充實豐富未成年人監(jiān)護立法的具體內容。
[Abstract]:At present, the minors' guardianship in our country is faced with the outstanding problems that need to be answered by legislation: the problem of minors being infringed by the guardian needs to be protected by perfecting the legislation, and the lack of guardianship faced by the left-behind children needs to be filled by the perfect legislation. The ownership of custody under the new type of parent-child relationship needs to be clarified through perfect legislation. The lack of legislation mainly includes: the legislation idea lags behind seriously, the system style is relatively scattered, and the specific provisions have obvious defects. In order to perfect the legislation of guardianship of minors, we should change the concept of legislation of guardianship of minors, form a complete and unified legal system of guardianship of minors, and enrich the concrete contents of legislation of guardianship of minors.
