【摘要】：綠色原則作為現(xiàn)代環(huán)境資源法(社會法范疇)的基本原則,能否成為民法基本原則,涉及兩個問題。一是從廣義上,社會法應(yīng)否和能否納入民法問題;二是在民法分則中能否設(shè)計出實現(xiàn)綠色原則的具體制度,從而使綠色原則的確立,與通過提取公因式的方法、歸納抽象基本原則的民法技術(shù)相協(xié)調(diào)。通過考察民法的解法典化與再法典化歷程可以發(fā)現(xiàn),民法的再法典化主要表現(xiàn)為民法對社會法的改造與吸收。通過對環(huán)境資源法的生產(chǎn)者延伸責(zé)任制度的分析可以發(fā)現(xiàn),對該制度進行民法改造,完全可以設(shè)計為民法制度。因此,民法確立綠色原則為基本原則,在理論上當(dāng)無問題。
[Abstract]:Green principle, as the basic principle of modern environmental law (social law category), involves two questions whether it can become the basic principle of civil law. One is whether social law should and can be incorporated into civil law in a broad sense, and the second is whether a specific system for realizing green principle can be designed in the special provisions of civil law, so that the establishment of green principle can be established and the method of extracting the common factor can be adopted. Summary of abstract basic principles of civil law technology coordination. By examining the process of decriminalization and recodification of civil law, it can be found that the recodification of civil law is mainly manifested in the reform and absorption of social law by civil law. Through the analysis of the extended producer responsibility system of the environmental and resource law, it can be found that the civil law reform of the system can be completely designed as the civil law system. Therefore, the civil law establishes the green principle as the basic principle, theoretically should be no problem.
