預(yù)購(gòu)商品房抵押預(yù)告登記制度研究

【摘要】:預(yù)購(gòu)商品房抵押預(yù)告登記是伴隨著我國(guó)商品房預(yù)售制度興起的一項(xiàng)配套制度,對(duì)控制銀行住房貸款的風(fēng)險(xiǎn)、促進(jìn)房地產(chǎn)市場(chǎng)的繁榮、滿足購(gòu)房人的融資需求發(fā)揮著至關(guān)重要的作用。然而對(duì)于如此重要、在期房買賣交易中運(yùn)用如此普遍的一種登記方式,卻僅出現(xiàn)在建設(shè)部頒布的《房屋登記辦法》這一部門規(guī)章以及各省市出臺(tái)《房地產(chǎn)登記條例》等地方性法規(guī)之中。就狹義的法律而言,目前尚缺乏對(duì)預(yù)購(gòu)商品房抵押預(yù)告登記的直接規(guī)定。這直接導(dǎo)致了在司法實(shí)踐中對(duì)預(yù)購(gòu)商品房抵押預(yù)告登記的性質(zhì)、效力理解不一,對(duì)銀行能否據(jù)此對(duì)預(yù)購(gòu)商品房行使抵押權(quán)這一預(yù)購(gòu)商品房抵押登記糾紛的核心問(wèn)題得出截然不同的裁判結(jié)論,呈現(xiàn)出司法嚴(yán)重不統(tǒng)一的現(xiàn)象。本文以一則預(yù)購(gòu)商品房抵押預(yù)告登記糾紛的典型案例為切入點(diǎn),從理論、立法、司法等不同維度對(duì)預(yù)購(gòu)商品房抵押預(yù)告登記制度進(jìn)行全方位的考量,探究我國(guó)現(xiàn)行預(yù)購(gòu)商品房抵押預(yù)告登記制度的不足,并提出相應(yīng)的立法完善建議,以期達(dá)到促成預(yù)購(gòu)商品房抵押預(yù)告登記在司法上更趨統(tǒng)一,在立法上更臻完善之目的。除引言外,本文分為五個(gè)部分,共約2萬(wàn)字。第一部,據(jù)以研究的案例。本部分簡(jiǎn)要介紹了一則預(yù)購(gòu)商品房抵押預(yù)告登記糾紛的典型案例,歸納了案例的爭(zhēng)議焦點(diǎn),引出本文擬探討的預(yù)購(gòu)商品房抵押預(yù)告登記的相關(guān)問(wèn)題。第二部分,預(yù)購(gòu)商品房抵押預(yù)告登記的理論考量。本部分主要對(duì)預(yù)購(gòu)商品房抵押登記的概念、性質(zhì)和意義等基礎(chǔ)理論進(jìn)行了探討。第三部分,預(yù)購(gòu)商品房抵押預(yù)告登記的立法考量。本部分主要從法律、部門規(guī)章、地方性法規(guī)三個(gè)層面上對(duì)關(guān)于預(yù)購(gòu)商品房抵押預(yù)告登記的規(guī)定進(jìn)行了梳理,并指出了預(yù)購(gòu)商品房抵押預(yù)告登記在立法上存在的不足。第四部分,預(yù)購(gòu)商品房抵押預(yù)告登記的司法考量。本部分主要對(duì)司實(shí)務(wù)中對(duì)于銀行能否基于預(yù)購(gòu)商品房抵押預(yù)告登記對(duì)預(yù)購(gòu)商品房行使抵押權(quán)這一預(yù)購(gòu)商品房抵押預(yù)告登記糾紛的核心問(wèn)題的不同裁判觀點(diǎn)進(jìn)行了介紹,對(duì)各裁判觀點(diǎn)及其理由進(jìn)行了評(píng)析,并分析了預(yù)購(gòu)商品房抵押預(yù)告登記的法律適用在司法實(shí)務(wù)中所呈現(xiàn)出來(lái)的問(wèn)題。第五部分,預(yù)購(gòu)商品抵押預(yù)告登記的立法完善。本部分對(duì)預(yù)購(gòu)商品抵押預(yù)告登記制度的完善給出了立法上的建議。第六部分,結(jié)語(yǔ)。本部分對(duì)據(jù)以研究的案例進(jìn)行了回顧,對(duì)全文進(jìn)行了總結(jié)。
[Abstract]:Pre-purchase of commercial housing mortgage registration is accompanied by the rise of commercial housing pre-sale system in China a supporting system to control the risk of bank housing loans and promote the prosperity of the real estate market. Meeting the financing needs of home buyers is playing a vital role. However, for such an important use of such a common form of registration in futures transactions, However, only in the Ministry of Construction promulgated "Housing Registration measures" this department regulations and provinces and cities issued "Real Estate Registration regulations" and other local laws and regulations. In the narrow sense of law, there is still a lack of advance purchase of commercial housing mortgage registration of direct provisions. This directly leads to the nature of pre-purchase commercial housing mortgage pre-registration in judicial practice, the effect of which is not the same. Whether the bank can exercise the mortgage right on the basis of which the central issue of the mortgage registration dispute of pre-purchase commercial housing can be drawn a completely different conclusion, showing the phenomenon of serious judicial disunity. This article regards a typical case of pre-purchase commercial house mortgage registration dispute as the breakthrough point, from the theory, legislation, judicature and other different dimensions of pre-purchase commercial housing mortgage pre-registration system for all-round consideration. This paper probes into the deficiency of the current pre-purchase commercial house mortgage advance registration system in our country, and puts forward the corresponding legislative perfection suggestions, in order to achieve the goal of promoting the prepurchase commercial housing mortgage advance registration to be more unified in the judicature and perfect in the legislation. In addition to the introduction, this article is divided into five parts, a total of about 20, 000 words. The first part is a case study. This part briefly introduces a typical case of pre-purchase commercial housing mortgage registration dispute, summarizes the dispute focus of the case, and leads to the related problems of pre-purchase commercial housing mortgage pre-registration. The second part, the advance purchase of commercial housing mortgage registration theoretical considerations. This part mainly discusses the concept, nature and significance of mortgage registration of prepurchase commercial housing. The third part, the advance purchase of commercial housing mortgage registration legislative considerations. This part mainly from the law, department regulations, local laws and regulations on the pre-purchase of commercial housing mortgage registration of three levels of combing the provisions, and pointed out the pre-purchase of commercial housing mortgage notice registration in the legislation of the shortcomings. The fourth part, the advance purchase of commercial housing mortgage registration of judicial considerations. This part mainly introduces the different referees' viewpoints on whether banks can exercise mortgage right on the basis of pre-purchase commercial housing mortgage registration, which is the core issue of pre-purchase commercial housing mortgage registration dispute in practice. This paper analyzes the opinions of the judges and their reasons, and analyzes the problems of the application of the law in the judicial practice. The fifth part, the legislation consummation of advance purchase commodity mortgage advance registration. This part gives legislative suggestions on the improvement of advance-purchase commodity mortgage registration system. The sixth part, conclusion. This part reviews the case based on the study and summarizes the full text.
