【摘要】：電信運(yùn)營(yíng)商網(wǎng)絡(luò)、有線電視網(wǎng)絡(luò)和計(jì)算機(jī)互聯(lián)網(wǎng)這三種原本相互獨(dú)立的網(wǎng)絡(luò)如今三網(wǎng)融合,產(chǎn)生了新事物——IPTV網(wǎng)絡(luò)電視,其通常以電視機(jī)為接收信息的終端,以互聯(lián)網(wǎng)為傳輸介質(zhì),為用戶提供娛樂(lè)視聽(tīng)的業(yè)務(wù)。IPTV是一種交互式通過(guò)網(wǎng)絡(luò)傳輸節(jié)目的傳播技術(shù),在實(shí)踐中產(chǎn)生了不少糾紛,學(xué)者發(fā)表的觀點(diǎn)也有很多意見(jiàn)分歧。本文從IPTV本身的技術(shù)特征出發(fā),對(duì)所涉及的廣播權(quán)和信息網(wǎng)絡(luò)傳播權(quán)進(jìn)行探討,結(jié)合一些相互矛盾的案例判決,展開(kāi)論述。全文共分為三章,外加結(jié)論,約二萬(wàn)五千多字。第一章:IPTV引發(fā)的相關(guān)著作權(quán)侵權(quán)問(wèn)題爭(zhēng)議。通過(guò)引用兩個(gè)有著截然不同的認(rèn)定和判決的相似案例,來(lái)說(shuō)明通過(guò)網(wǎng)絡(luò)傳播電視節(jié)目來(lái)實(shí)現(xiàn)一系列功能的IPTV,其所實(shí)現(xiàn)的功能在法律上適用權(quán)利認(rèn)定是存在一定爭(zhēng)議的。由于IPTV是一個(gè)技術(shù)產(chǎn)物,很多人只是從使用者的角度了解其帶給人們的一些功能,但是對(duì)其運(yùn)營(yíng)模式、技術(shù)概念、應(yīng)用特點(diǎn)及發(fā)展現(xiàn)狀不是很了解,筆者從內(nèi)剖析,引出其所產(chǎn)生的相關(guān)的著作權(quán)侵權(quán)問(wèn)題,正是這樣與我們生活?yuàn)蕵?lè)息息相關(guān)的IPTV,點(diǎn)出對(duì)其引發(fā)的侵權(quán)問(wèn)題研究更具有意義和價(jià)值。第二章:IPTV功能的法律定性。當(dāng)網(wǎng)絡(luò)時(shí)代的到來(lái),傳統(tǒng)版權(quán)已經(jīng)不適應(yīng)新時(shí)代產(chǎn)生的版權(quán)侵權(quán)問(wèn)題的有效解決,著作權(quán)與網(wǎng)絡(luò)的結(jié)合是歷史不可避免的自然演進(jìn)規(guī)則。IPTV的直播、回看功能主要混淆了著作權(quán)中的廣播權(quán)和信息網(wǎng)絡(luò)傳播權(quán),文中論述了廣播權(quán)和信息網(wǎng)絡(luò)傳播權(quán)的區(qū)別,和在IPTV不同的服務(wù)功能的適用上的不同。第三章:IPTV業(yè)務(wù)中著作權(quán)侵權(quán)責(zé)任的承擔(dān)。概述IPTV業(yè)務(wù)侵權(quán)行為的主體,侵權(quán)行為的歸責(zé)原則,侵權(quán)行為的法律責(zé)任,同時(shí)通過(guò)經(jīng)典的IPTV侵權(quán)案例,對(duì)IPTV業(yè)務(wù)中具體侵權(quán)行為的責(zé)任進(jìn)行了論述介紹,其中圍繞電信在IPTV業(yè)務(wù)中承擔(dān)的角色,是否與百視通共同承擔(dān)侵權(quán)責(zé)任展開(kāi)分析,并提出了筆者的看法。結(jié)論:簡(jiǎn)要闡述IPTV技術(shù)和運(yùn)營(yíng)模式未來(lái)發(fā)展趨勢(shì),對(duì)其所適用的法律也應(yīng)逐步進(jìn)步和完善,在平衡利益之外,在認(rèn)可基礎(chǔ)的條件下,制定符合商業(yè)規(guī)則的法律,使其具有現(xiàn)實(shí)操作對(duì)于IPTV網(wǎng)絡(luò)服務(wù)提供者來(lái)說(shuō)僅獲得廣播權(quán)是不夠的,還要取得點(diǎn)播、回看作品的“信息網(wǎng)絡(luò)傳播權(quán)”。
[Abstract]:The telecommunication operator network, cable television network and computer Internet, which were originally independent of each other, are now converging with each other, resulting in a new phenomenon IPTV network television, which usually uses television as the terminal for receiving information. IPTV, which takes the Internet as the transmission medium, provides entertainment for users. IPTV is a kind of interactive transmission technology of programs over the network. In practice, there have been a lot of disputes, and many opinions have been expressed by scholars. Based on the technical characteristics of IPTV, this paper discusses the broadcast right and information network transmission right, and discusses some contradictory cases. The full text is divided into three chapters, plus conclusions, about 25000 words. Chapter one: the controversy of copyright infringement caused by IPTV. By quoting two similar cases which have different cognizance and judgment, this paper explains that IPTV, which realizes a series of functions by means of network communication TV program, has some disputes on the legal application of IPTV. Because IPTV is a technology product, many people only understand some functions it brings to people from the point of view of users, but it is not very clear about its operation mode, technical concept, application characteristics and development status. It is the IPTV which is closely related to our life and entertainment. It is more meaningful and valuable to point out the infringement problem caused by IPTV. Chapter two: legal characterization of IPTV function. With the advent of the network age, the traditional copyright has not been adapted to the effective solution of the copyright infringement problem produced in the new era. The combination of copyright and network is the inevitable natural evolution rule of history. IPTV is broadcast live. The function of looking back mainly confuses the broadcast right and the information network transmission right in the copyright. This paper discusses the difference between the broadcast right and the information network transmission right, and the difference in the application of the different service functions of IPTV. Chapter three: the liability of copyright infringement in IPTV business. This paper summarizes the main body of IPTV business tort, the principle of tort liability, and the legal liability of tort. At the same time, through the classic IPTV tort case, the author introduces the specific tort liability in IPTV business. This paper analyzes the role of telecom in IPTV business and whether it bears tort liability with Blockcom, and puts forward the author's opinion. Conclusion: the development trend of IPTV technology and operation mode in the future should be briefly described, and the applicable law should be improved step by step. In addition to balancing interests and under the condition of recognition foundation, the law should be formulated in accordance with commercial rules. It is not enough for the IPTV network service provider to obtain broadcasting right only, but also to obtain the on-demand broadcasting, and to look back at the "right of information network dissemination" of the works.
