【摘要】：現(xiàn)代化《德國民法典》注重消費者的特殊保護,在民事主體部分統(tǒng)一規(guī)定"消費者"與"經(jīng)營者"的概念;為避免雙軌制私法體系的威脅,通過2002年債法改革將消費者特別法體系化整合進入民法典,達到統(tǒng)一保護消費者的目的。我國正在編纂的民法典可以對此借鑒,通過總則部分納入"消費者-經(jīng)營者"的一體化概念,在"合同編"規(guī)定"消費者合同"的重要制度——細化格式條款的法律干預(yù),納入并完善消費者的撤回權(quán)制度,達到抽象人格向具體人格、形式正義向?qū)嵸|(zhì)正義的轉(zhuǎn)變。如此通過消費者法的民法回歸實現(xiàn)民法的再法典化和現(xiàn)代化。
[Abstract]:In the civil subject part, the concept of "consumer" and "operator" is unified in the civil subject part of the modern "German Civil Code". In order to avoid the threat of the dual track system of private law, the system of consumer special law is integrated into the civil code through the reform of the debt law in 2002 to achieve the purpose of unified protection of the consumer. The civil code can be used for reference. Through the general principle, the concept of "consumer - Operator" is incorporated into the concept of "consumer contract". In the "contract compilation", the important system of "consumer contract" is to refine the legal intervention of the form clause, and to perfect the system of the withdrawal right of the consumer, to the transfer of the abstract personality to the concrete personality, the form justice to the substantive justice. Thus, through the civil law of the consumer law, we can achieve the codification and modernization of the civil law.
