【摘要】：生前預(yù)囑允許人們通過(guò)提前簽署相應(yīng)文件對(duì)臨終醫(yī)療護(hù)理進(jìn)行選擇,維護(hù)自身的尊嚴(yán)。盡管其目的不是強(qiáng)制性要求公民的應(yīng)用,但在中國(guó)的發(fā)展仍處于探索階段,且社會(huì)認(rèn)可度較低,只有立法是其發(fā)展的前提和保障。在理清生前預(yù)囑界定的基礎(chǔ)上,借鑒先行國(guó)家的開展經(jīng)驗(yàn)并結(jié)合中國(guó)的實(shí)踐情況,以立法為基礎(chǔ),確立其實(shí)施主體,規(guī)范其實(shí)施要求,制定嚴(yán)謹(jǐn)?shù)牧�、鑒定、實(shí)施、撤銷程序,保障患者的自主選擇,為生前預(yù)囑的法律建設(shè)提供參考,進(jìn)而促進(jìn)其在中國(guó)的發(fā)展和應(yīng)用。
[Abstract]:Living wills allow people to choose hospice care by signing documents in advance to preserve their dignity. Although the purpose is not mandatory to require the application of citizens, but the development in China is still in the exploratory stage, and the social recognition is low, only legislation is the premise and guarantee of its development. On the basis of clarifying the definition of living wills, drawing lessons from the experience of the leading countries and combining the practical situation in China, based on legislation, establishing the main body of its implementation, standardizing its implementation requirements, formulating strict wills, appraisals, and implementing, The procedure of revocation ensures the patient's independent choice and provides a reference for the legal construction of living wills, thus promoting its development and application in China.
