【摘要】：政府購買養(yǎng)老服務(wù)是指政府為了更好的履行其在社會(huì)養(yǎng)老中提供養(yǎng)老服務(wù)的行政職責(zé),采用市場運(yùn)行機(jī)制,將原應(yīng)由政府直接提供的養(yǎng)老服務(wù)以行政采購的方式,通過一定的程序轉(zhuǎn)交給有相應(yīng)養(yǎng)老服務(wù)能力的社會(huì)養(yǎng)老組織,政府根據(jù)社會(huì)養(yǎng)老組織提供養(yǎng)老服務(wù)的數(shù)量以及質(zhì)量將財(cái)政對社會(huì)福利的一部分預(yù)算經(jīng)費(fèi)支付給社會(huì)養(yǎng)老組織的一種制度。目前,我國政府購買養(yǎng)老服務(wù)相關(guān)立法不完善,主要依照大量規(guī)范性文件實(shí)施,然而政府購買養(yǎng)老服務(wù)法律性質(zhì)不清楚、政府責(zé)任不明確,缺乏完善的綜合評審與信息披露機(jī)制,應(yīng)當(dāng)通過完善我國政府購買養(yǎng)老服務(wù)的立法、嚴(yán)格執(zhí)行政府購買養(yǎng)老服務(wù)的規(guī)范性法律文件、明確政府購買養(yǎng)老服務(wù)行為的法律性質(zhì)與政府職責(zé)、并且完善政府購買養(yǎng)老服務(wù)綜合評審與信息披露機(jī)制來逐步實(shí)現(xiàn)我國政府購買養(yǎng)老服務(wù)法制化路徑。
[Abstract]:Government purchase of old-age service means that in order to better fulfill its administrative duty of providing old-age service in the social old-age care, the government adopts the market operation mechanism to purchase the old-age service which should be provided directly by the government in the form of administrative procurement.Through certain procedures, they are transferred to social pension organizations that have the corresponding ability to provide services for the aged.A system whereby the government pays part of the budget for social welfare to social pension organizations according to the quantity and quality of pension services provided by social pension organizations.At present, the legislation related to the purchase of pension services is not perfect in our country, which is mainly implemented in accordance with a large number of normative documents. However, the legal nature of the purchase of pension services by the government is not clear and the responsibility of the government is not clear.There is no perfect mechanism of comprehensive evaluation and information disclosure, so we should strictly enforce the normative and legal documents of government purchasing old-age service by perfecting our government's legislation on the purchase of old-age care services.It is clear the legal nature and responsibility of the government to purchase old-age service and perfect the mechanism of comprehensive evaluation and information disclosure to gradually realize the legalization path of government purchase of old-age service in our country.
