【摘要】：隨著我國社會主義市場經(jīng)濟的日益繁榮和民主政治的不斷發(fā)展,網(wǎng)民也開始積極地參與國家各項政治生活�；ヂ�(lián)網(wǎng)的高速發(fā)展和普及,使網(wǎng)絡監(jiān)督的方式變得更加方便快捷,網(wǎng)絡反腐成為互聯(lián)網(wǎng)時代一種全新的群眾監(jiān)督形式。網(wǎng)絡時代,每個人能夠隨時隨地自由地通過互聯(lián)網(wǎng)發(fā)布自己感興趣的言論。從許多熱點網(wǎng)絡反腐事件中我們可以看出,網(wǎng)絡曝光已經(jīng)成為腐敗案件查處的一條重要路徑。由于網(wǎng)絡反腐目前正處于初步發(fā)展階段,所以仍然存在很多不足。網(wǎng)絡反腐在揭露官員腐敗的同時,有部分居心叵測的網(wǎng)民會在網(wǎng)絡中隨意發(fā)表某些不實言論。大多數(shù)網(wǎng)民對官員的腐敗行為深惡痛絕,不經(jīng)求證就輕信這一傳言并廣泛進行網(wǎng)絡傳播,導致網(wǎng)絡謠言四起。他們沒有注意到要對被檢舉人及其親人朋友的隱私權進行保護。即使是貪官和其他犯罪分子,在法律上也有隱私權、名譽權和人格尊嚴不受侵犯權等人身權利。本文將從時代發(fā)展的背景出發(fā),結(jié)合國內(nèi)外的研究現(xiàn)狀,對網(wǎng)絡謠言的成因、危害以及其作用于反腐的影響進行研究。文章主要分為五個部分：第一部分論述網(wǎng)絡謠言概念的界定；第二部分采用了案例分析法,以“前四川達縣縣委書記李春”的網(wǎng)絡反腐謠言為例,通過對具體案例的深入挖掘和剖析,對網(wǎng)絡反腐事件的曝光傳播過程進行分析闡釋,論述了網(wǎng)絡謠言對反腐產(chǎn)生影響的現(xiàn)象分析；第三部分通過比較研究法,從技術、社會、心理、法律等各方面尤其是法律方面,分析了網(wǎng)絡謠言對反腐產(chǎn)生影響的原因；第四部分仔細闡述了網(wǎng)絡反腐謠言的各種危害；文章的最后一部分針對現(xiàn)階段網(wǎng)絡謠言使反腐面臨的困境提出了具體的解決方法,促進網(wǎng)絡反腐朝著科學化、完善化和理性化的角度發(fā)展。與以往單純對網(wǎng)絡謠言的成因、危害及其治理對策等方面的研究相比,本文將網(wǎng)絡謠言與反腐兩大熱點相結(jié)合,通過對網(wǎng)絡謠言作用于反腐的影響研究,從而提出具體的相關法律規(guī)制措施。從理論意義上講,首先,本文將對網(wǎng)絡謠言的研究現(xiàn)狀進行全面系統(tǒng)的梳理,并提出相關的治理對策,一定程度上補充網(wǎng)絡謠言治理方面的相關理論；其次,本文將從隱私權、名譽權的角度來深入研究網(wǎng)絡謠言對反腐的影響,并提出對網(wǎng)絡謠言的法律規(guī)制措施,以嶄新的理論視角對網(wǎng)絡謠言問題進行剖析分解。從現(xiàn)實意義上講,首先,本文將有助于引導網(wǎng)民進行理性的言論行為,增強網(wǎng)絡的制度化服務；其次,有利于強化對網(wǎng)絡謠言危機的預警機制,化解當代中國社會的信任危機；最后,本文將提出網(wǎng)絡謠言治理的相關對策,能夠為政府部門在治理網(wǎng)絡謠言方面提供一些參考意見,從而促進社會的穩(wěn)定發(fā)展。
[Abstract]:With the increasing prosperity of socialist market economy and the development of democratic politics, netizens have also actively participated in the political life of the country.With the rapid development and popularization of the Internet, the way of network supervision becomes more convenient and fast. Network anti-corruption has become a new form of mass supervision in the Internet era.In the Internet age, everyone can freely publish their interested speech through the Internet anytime and anywhere.From many hot network anti-corruption incidents, we can see that network exposure has become an important way to investigate and deal with corruption cases.Because the network anti-corruption is in the initial stage of development, so there are still many deficiencies.While exposing official corruption, some Internet users with malicious intentions will make false remarks on the Internet.Most Internet users loathe officials' corrupt practices, believing the rumor without verification and spreading it widely on the Internet, leading to widespread online rumors.They did not notice the need to protect the privacy of informants and their relatives and friends.Even corrupt officials and other criminals have the right to privacy, reputation and personal dignity.Based on the background of the development of the times and the current research situation at home and abroad, this paper will study the causes, harm and influence of Internet rumors on anti-corruption.The article is divided into five parts: the first part discusses the definition of the concept of network rumor, the second part uses the case analysis method, taking "Li Chun, former secretary of Sichuan Daxian county party committee" as an example,Through the deep excavation and analysis of specific cases, this paper analyzes and explains the exposure and communication process of the network anti-corruption incident, and discusses the phenomenon of the influence of the network rumor on the anti-corruption; the third part, through the comparative research method, from the technology, the society,The psychological, legal and other aspects, especially the legal aspects, have analyzed the causes of the influence of network rumors on anti-corruption, the fourth part has elaborated the various kinds of harm of the network anti-corruption rumors;In the last part of the article, the author puts forward some concrete solutions to the plight of anti-corruption caused by Internet rumors at present, and promotes the development of network anti-corruption from the angle of scientific, perfect and rational.Compared with the previous researches on the causes, harms and countermeasures of network rumors, this paper combines the online rumors with the two hot spots of anti-corruption, and studies the influence of the online rumors on the anti-corruption.In order to put forward specific legal regulation measures.Theoretically speaking, first of all, this paper will make a comprehensive and systematic analysis of the current research situation of network rumors, and put forward the relevant governance measures, to a certain extent, supplement the relevant theories of network rumor governance; secondly, this paper will from the right to privacy,From the perspective of reputation right, this paper deeply studies the influence of network rumor on anti-corruption, and puts forward the legal regulation measures of network rumor, and analyzes and decomposes the problem of network rumor from a new theoretical perspective.In practical sense, firstly, this paper will help to guide the netizens to conduct rational speech behavior and strengthen the institutionalized service of the network; secondly, it will help to strengthen the early warning mechanism of the network rumor crisis and resolve the trust crisis in the contemporary Chinese society.Finally, this paper will put forward the relevant countermeasures for the governance of network rumors, which can provide some reference for government departments in the governance of online rumors, thereby promoting the stable development of society.
