【摘要】：被遺忘權(quán)不僅在大數(shù)據(jù)領(lǐng)域中存在,而且在古典的隱私權(quán)或者個(gè)人信息權(quán)(信息隱私權(quán))領(lǐng)域中也存在。在大數(shù)據(jù)領(lǐng)域中,被遺忘權(quán)以刪除權(quán)為主要內(nèi)容,而在非大數(shù)據(jù)領(lǐng)域中,被遺忘權(quán)以禁止或者限制收集、使用為主要內(nèi)容。在大數(shù)據(jù)領(lǐng)域中,被遺忘權(quán)的出現(xiàn)并沒(méi)有產(chǎn)生一種完全獨(dú)立的新興權(quán)利,毋寧是在古典隱私權(quán)的地基上并依賴(lài)于個(gè)人信息權(quán)(信息隱私權(quán))的保護(hù),增加了廣義的隱私權(quán)的內(nèi)容。對(duì)個(gè)人信息權(quán)和被遺忘權(quán)的認(rèn)知應(yīng)當(dāng)在古典隱私權(quán)的地基上進(jìn)行。
[Abstract]:The right to be forgotten exists not only in the field of big data, but also in the field of classical privacy or personal information right (information privacy).In the field of big data, the right to be forgotten takes the right to delete as the main content, while in the field of non-#china_person1#, the right to be forgotten is to prohibit or restrict collection, use as the main content.In the field of big data, the emergence of the right to be forgotten does not produce a completely independent new right, rather it is based on the foundation of the classical right of privacy and relies on the protection of the right to personal information (the right to information privacy).Added broad sense of privacy content.The recognition of the right to personal information and the right to be forgotten should be based on the classical right of privacy.
