《侵權(quán)責(zé)任法》第40條的基礎(chǔ)理論探析

【摘要】:在第三人襲擊校園傷害學(xué)生的侵害事故中,受害學(xué)生和家長(zhǎng)在獲得法律救濟(jì)過程中主要的法律依據(jù)就是《侵權(quán)責(zé)任法》第40條。然而本文通過對(duì)《侵權(quán)責(zé)任法》第40條進(jìn)行基礎(chǔ)理論分析過程中發(fā)現(xiàn),其價(jià)值定位有悖于《侵權(quán)責(zé)任法》的“權(quán)利救濟(jì)法”核心價(jià)值定位之立場(chǎng),對(duì)受害學(xué)生的救濟(jì)力度不夠,在應(yīng)然的角度上有失公平公正。有鑒于此,本文以“歸責(zé)原則”和“受害人的法益保護(hù)及救濟(jì)”為出發(fā)點(diǎn)對(duì)《侵權(quán)責(zé)任法》第40條進(jìn)行橫向和縱向的比較分析:橫向上,通過第40條與第37條和38條的比較分析可知第40條的存在使得整部《侵權(quán)責(zé)任法》的體系呈現(xiàn)出不一或日紊亂;縱向上,通過對(duì)第40條的價(jià)值定位的分析可知其有悖于《侵權(quán)責(zé)任法》的“權(quán)利救濟(jì)法”的核心價(jià)值定位。最后本文從解釋論和立法論的角度對(duì)《侵權(quán)責(zé)任法》第40條進(jìn)行了有益于受害學(xué)生的論述和建議,以期能夠平衡處于弱勢(shì)群體地位的受害學(xué)生之法律利益。
[Abstract]:In the case of the third person attacking the campus to injure the students, the main legal basis for the injured students and their parents in the process of obtaining legal relief is Article 40 of the Tort liability Law.However, through the basic theoretical analysis of Article 40 of the Tort liability Law, it is found that its value orientation is contrary to the core value orientation of the right Relief Law of the Tort liability Law, and the relief to the injured students is not enough.There is a lack of fairness and justice from the point of view of what should be done.In view of this, this paper makes a horizontal and vertical comparative analysis of Article 40 of the Tort liability Law based on the "imputation principle" and "legal interest protection and relief of the victim": horizontally,Through the comparative analysis of article 40 with articles 37 and 38, it can be seen that the existence of article 40 makes the whole system of Tort Law appear different or disordered day by day.Through the analysis of the value orientation of Article 40, it can be seen that Article 40 is contrary to the core value orientation of the right remedy Law of Tort liability Law.Finally, from the angle of interpretation and legislation, the article 40 of the Tort liability Law is discussed and suggested to benefit the injured students, in order to balance the legal interests of the injured students in the position of the disadvantaged groups.
