【摘要】：司法實(shí)踐中就行人非法進(jìn)入高速公路受到傷害的案件在法律適用上存在較大分歧,高速公路經(jīng)營(yíng)者是否承擔(dān)責(zé)任、承擔(dān)責(zé)任的依據(jù)、歸責(zé)原則和具體計(jì)算均不一致。通過(guò)實(shí)證研究和理論分析可知,高速公路交通運(yùn)輸屬于高度危險(xiǎn)活動(dòng),但高速公路并非絕對(duì)就是高度危險(xiǎn)活動(dòng)區(qū)域;高度危險(xiǎn)活動(dòng)區(qū)域的認(rèn)定應(yīng)具有相對(duì)性,行人非法進(jìn)入高速公路時(shí)高速公路才可被認(rèn)定為高度危險(xiǎn)活動(dòng)區(qū)域,高速公路經(jīng)營(yíng)者才承擔(dān)高度危險(xiǎn)責(zé)任,此時(shí),高速公路經(jīng)營(yíng)者應(yīng)承擔(dān)的是一種加重型過(guò)錯(cuò)推定責(zé)任。此類事故中,高速公路經(jīng)營(yíng)者和肇事第三方應(yīng)根據(jù)各自有無(wú)過(guò)錯(cuò)、第三方客觀上能否給予賠償之不同,承擔(dān)按份責(zé)任或無(wú)追償權(quán)的不完全補(bǔ)充責(zé)任。
[Abstract]:In judicial practice, there are great differences in the application of the law in the case of illegal pedestrian entering the expressway. Whether the expressway operator should bear the responsibility and the basis for the responsibility, The principle of imputation and concrete calculation are inconsistent. Through empirical research and theoretical analysis, it can be seen that highway traffic and transportation belong to highly dangerous activities, but expressway is not absolutely the area of highly dangerous activities. The identification of a highly dangerous activity area should be relative. Only when a pedestrian enters the expressway illegally can the expressway be recognized as a highly dangerous activity area, and the expressway operator bear the high hazard responsibility. In this kind of accident, the expressway operator and the third party of the accident should, according to whether they are at fault or not, be able to give compensation objectively. To assume partial liability or incomplete supplemental liability without recourse.
