【摘要】：業(yè)主團體是我國進行房改之后出現(xiàn)的一個新概念,實際上是小區(qū)各個業(yè)主為了實行個人利益和共同利益聚集起來管理小區(qū)事務的組織。各國立法對此有著不同的稱謂,法國《住宅分層所有權法》稱之為協(xié)同管理團體;德國《住宅所有權法》稱之為住宅所有權人共同關系團體,即住宅所有人共同體;日本《建筑物區(qū)分所有權法》將業(yè)主團體按性質的不同分為三類:管理團體、管理組合法人及社區(qū)管理團體。雖然各國立法的稱謂不同,但它的出現(xiàn)無疑對各國民法特別是建筑物區(qū)分所有權領域有著重大的意義。上世紀80年代商品房市場化趨勢逐漸加強,各城市小區(qū)的數(shù)量、規(guī)模呈擴張的態(tài)勢,人們的居住方式發(fā)生了巨大的變化,由以往獨門獨院的居住方式演變?yōu)榫奂谝黄鸬纳罘绞�。業(yè)主購買小區(qū)的房產后,除了需要處理專有部分所有權的關系,還因為共用部分的存在需要處理與其他業(yè)主的關系即共用部分持份權。這種不同于以往的法律關系的出現(xiàn)為使得小區(qū)的管理更具復雜性。本文運用比較分析、實證研究的方法,從業(yè)主團體自治的相關概念入手,敘述業(yè)主團體進行管理需要遵守的原則和發(fā)揮的作用,然后運用政治學、社會學、民法學理論分析其理論的正當性,同時結合國外立法論述其自治的內容,包括進行管理的內容、業(yè)主公約、業(yè)主團體的運行等內容,在上述理論的基礎上分析我國當前業(yè)主團體自治所面臨的一系列問題,如業(yè)主團體法律定性的缺失、業(yè)主團體與物業(yè)公司的關系定位不當?shù)葐栴}。通過揭示我國業(yè)主團體自治存在的不同問題,提出相關建議和措施,以期能夠豐富其理論,解決實踐中出現(xiàn)的部分問題,充分發(fā)揮出業(yè)主團體在私法領域的功能和作用。
[Abstract]:The owners group after China's housing reform is the emergence of a new concept, is actually the plot each owners to implement individual interests and the common interests together the management of district affairs organization. This is different in the past the legal relationship in order to make the community management more complicated. This paper uses comparative analysis, empirical research methods, starting from the relevant concepts of the owners of autonomous group, the owners group management should abide by the principles and the role and use of political science, sociology, analysis the legitimacy of its theory of civil law the theory, combined with foreign legislation and discusses its autonomous content, including the content of the management, the Convention on the owners, owners group operation etc., in the theoretical basis Analysis of a series of problems in China's current owners autonomous group facing the basis, such as the lack of legal owner group qualitative, positioning the relationship between owners and property companies group improper. By revealing the different problems of our owners autonomous group, puts forward relevant suggestions and measures, in order to enrich the theory and solve the problems arising in practice, give full play to the function and role of the owners group in the field of private law.
