【摘要】：我國物權(quán)法中未規(guī)定間接占有制度,但間接占有在理論上有重要意義。針對占有所享有的三大功能即保護(hù)功能、物權(quán)移轉(zhuǎn)功能和公示功能進(jìn)行逐一分析可以得出以下結(jié)論:間接占有與直接占有一樣承擔(dān)著保護(hù)功能和物權(quán)移轉(zhuǎn)功能。但基于間接占有之特殊性,其不具有物權(quán)公示作用。占有推定之所以可以成立是以間接占有的物權(quán)移轉(zhuǎn)功能為基礎(chǔ)的。
[Abstract]:The system of indirect possession is not stipulated in the property law of our country, but the indirect possession is of great significance in theory. Through the analysis of the transfer function of real right and the function of publicity, we can draw the following conclusions: indirect possession bears the function of protection and transfer of real right as direct possession, but based on the particularity of indirect possession, The presumption of possession is based on the transfer function of indirect possession.
