【摘要】：近年來,隨著互聯(lián)網(wǎng)的飛速發(fā)展,社交網(wǎng)絡(luò)已經(jīng)成了人際交往的重要手段。微博以使用方便,短小精悍,受眾面廣,傳播速度快的優(yōu)勢(shì)在當(dāng)前這個(gè)網(wǎng)絡(luò)時(shí)代迅速脫穎而出,成為時(shí)下最受歡迎的社交網(wǎng)絡(luò)工具。而轉(zhuǎn)發(fā)則是微博用戶分享和傳播微博信息的主要途徑,也是衡量微博影響力的重要標(biāo)志。人們?cè)陔S手轉(zhuǎn)發(fā)微博的同時(shí)往往會(huì)忽略其中隱含的著作權(quán)風(fēng)險(xiǎn),導(dǎo)致微博著作權(quán)侵權(quán)現(xiàn)象層出不窮,損害了著作權(quán)人的合法權(quán)益。而與微博的快速發(fā)展形成鮮明對(duì)比的是我們國(guó)家對(duì)于微博相關(guān)著作權(quán)保護(hù)的法律制度還比較落后,人們的微博著作權(quán)保護(hù)意識(shí)還非常薄弱。在這種形勢(shì)下,促進(jìn)微博的健康快速發(fā)展的同時(shí)如何更好的保護(hù)微博著作權(quán)人的權(quán)益就成了亟待人們關(guān)注的問題。因此,本文以域外Twitter為基礎(chǔ),以轉(zhuǎn)發(fā)行為發(fā)生的環(huán)境不同,對(duì)微博轉(zhuǎn)發(fā)行為進(jìn)行類型化梳理,并從著作權(quán)人專有權(quán)利控制行為的角度進(jìn)行定性。通過對(duì)微博轉(zhuǎn)發(fā)行為界限的辨析,進(jìn)而對(duì)微博轉(zhuǎn)發(fā)侵權(quán)行為構(gòu)成及侵權(quán)責(zé)任認(rèn)定等多方性問題進(jìn)行整體把握,同時(shí)結(jié)合現(xiàn)實(shí)闡述了我國(guó)當(dāng)前在微博轉(zhuǎn)發(fā)著作權(quán)方面存在的問題與完善意見,力求為新興的微博文化發(fā)展提供優(yōu)良的法律環(huán)境。
[Abstract]:In recent years, with the rapid development of the Internet, the social network has become an important means of interpersonal communication. Weibo, with its advantages of convenience, brevity, popularity and speed of communication, has quickly stood out in the current network age. To become the most popular social networking tool nowadays. And forwarding is the main way for Weibo users to share and disseminate Weibo information. It is also an important indicator of Weibo's influence. People often ignore the implied copyright risks while relaying Weibo, which leads to an endless phenomenon of copyright infringement in Weibo. It has damaged the legitimate rights and interests of copyright owners. What contrasts sharply with Weibo's rapid development is the fact that our country's legal system for the protection of the copyright related to Weibo is still relatively backward. Weibo's awareness of copyright protection is still very weak. Under this situation, how to better protect the rights and interests of Weibo copyright owners while promoting the healthy and rapid development of Weibo has become an urgent issue for people to pay close attention to. Based on the extraterritorial Twitter and the different environment of forwarding behavior, this paper classifies Weibo's forwarding behavior and qualitatively from the perspective of copyright owner's exclusive right control behavior. Furthermore, the author grasps the constitution of Weibo's tort act and the identification of tort liability as a whole, at the same time expounds the existing problems and perfect opinions in the copyright forwarding of Weibo in our country in combination with the reality. Strive to provide an excellent legal environment for the new Weibo culture development.
