【摘要】：正一般認(rèn)為,商標(biāo)權(quán)主要可分為使用權(quán)和禁用權(quán)兩部分,一"行"一"禁"相輔相成。使用權(quán)屬于積極權(quán)利,是指商標(biāo)權(quán)人有使用核準(zhǔn)注冊(cè)的商標(biāo)并由此獲益的權(quán)利。而禁用權(quán)則屬于消極權(quán)利,是指禁止他人對(duì)核準(zhǔn)注冊(cè)的商標(biāo)實(shí)施侵權(quán)的權(quán)利。具體而言,禁用權(quán)可分為4種不同的情況,即禁止他人在同一種、類似商品上使用相同、近似商標(biāo)。[1]由此可見(jiàn),商標(biāo)禁用權(quán)的范圍遠(yuǎn)大于商標(biāo)使用權(quán),這是因?yàn)樯虡?biāo)禁用權(quán)的存在意義是
[Abstract]:It is generally believed that trademark rights can be divided into two parts: the right to use and the right to ban. It means that the trademark owner has the right to use the approved registered trademark and to benefit therefrom. The right to ban the right to prohibit others from infringing upon the approved registered trademark is a negative right. The prohibition right can be divided into four different situations, that is, forbidding others to use the same kind of goods, similar goods, similar trademark.
