【摘要】：外觀設(shè)計(jì)的優(yōu)劣直接影響產(chǎn)品的銷售,優(yōu)秀的外觀設(shè)計(jì)可以提高產(chǎn)品本身的價(jià)值。因工業(yè)產(chǎn)品外觀設(shè)計(jì)的自身屬性,工業(yè)產(chǎn)品外觀設(shè)計(jì)受到專利法、版權(quán)法和商標(biāo)法的多重保護(hù)。在已經(jīng)簽署的關(guān)于知識(shí)產(chǎn)權(quán)的世界性條約中,對(duì)各個(gè)締約國工業(yè)產(chǎn)品外觀設(shè)計(jì)的保護(hù)方式并未做詳細(xì)要求,僅要求必須保護(hù),由各國確定保護(hù)程度、保護(hù)方式等相關(guān)規(guī)則,由此導(dǎo)致工業(yè)產(chǎn)品外觀設(shè)計(jì)法律保護(hù)上的缺失和沖突,阻礙正當(dāng)競爭和正常貿(mào)易秩序。論文首先對(duì)工業(yè)產(chǎn)品外觀設(shè)計(jì)的內(nèi)涵與外延進(jìn)行明確的界定,繼之對(duì)各個(gè)相關(guān)國際公約中的規(guī)定、歐盟和美國對(duì)工業(yè)產(chǎn)品外觀設(shè)計(jì)法律保護(hù)的立法與實(shí)踐進(jìn)行系統(tǒng)考察,分析國際條約和各國國內(nèi)法對(duì)工業(yè)產(chǎn)品外觀設(shè)計(jì)法律保護(hù)的特點(diǎn)及各自的優(yōu)劣,在此基礎(chǔ)上,全面考察我國工業(yè)產(chǎn)品外觀設(shè)計(jì)法律保護(hù)方面的立法與實(shí)踐,提出我國工業(yè)產(chǎn)品外觀設(shè)計(jì)法律保護(hù)在審查周期、保護(hù)期限、外觀設(shè)計(jì)專利判斷主體、創(chuàng)造性標(biāo)準(zhǔn)、混淆標(biāo)準(zhǔn)以及局部外觀設(shè)計(jì)保護(hù)等方面存在的問題,并相應(yīng)的提出完善的建議。
[Abstract]:The merits and demerits of the design directly affect the sale of the product. Excellent design can improve the value of the product itself. Because of the property of the industrial product design, the industrial product design is subject to the patent law. Copyright Law and Trademark Law. In the world treaties on intellectual property that have been signed, there are no detailed requirements for the way in which industrial product designs are protected in each Contracting State, but only the need to protect them. The degree of protection, the way of protection and other relevant rules are determined by various countries, which leads to the lack of and conflicts in the legal protection of industrial product design. The thesis firstly defines the connotation and extension of industrial product appearance design, and then defines the provisions of each relevant international convention. The European Union and the United States made a systematic investigation on the legislation and practice of the legal protection of industrial product design, and analyzed the characteristics and advantages and disadvantages of the legal protection of industrial product design under international treaties and domestic laws. The legislation and practice of the legal protection of industrial product appearance design in China are comprehensively investigated, and the legal protection of industrial product appearance design in our country is put forward in the period of examination, the period of protection, the subject of judging the patent of design, the creative standard. Confusion standards and local design protection and other problems, and corresponding suggestions.
