【摘要】：隨著微博這種新媒體的誕生，相應的即時和碎片化的信息傳播形式迅速進入公眾的視野，，成為當下非常主流的信息傳播模式。微博在改變?nèi)藗兩畹耐瑫r也帶來了新的侵權(quán)行為模式。這種通過微博運作產(chǎn)生的信息侵權(quán)對人們的姓名、肖像、榮譽甚至著作權(quán)等權(quán)益產(chǎn)生的侵害發(fā)生更快、范圍更廣且更加難以控制。這給司法實踐中傳統(tǒng)的維權(quán)方法帶來了新的難題。這些難題一方面體現(xiàn)在司法實踐中傳統(tǒng)的訴訟程序在應對微博侵權(quán)引發(fā)的侵權(quán)案件審理中屢遇尷尬，另一方面體現(xiàn)在微博侵權(quán)的特點使得我們想要應對微博侵權(quán)進行維權(quán)則需要在預防上尋找新的突破點。文章在探討和總結(jié)微博侵權(quán)行的諸多表現(xiàn)和新特點的基礎上，分析微博侵權(quán)面臨的困境以及相應的制度成因，以求能夠?qū)ΠY下藥，找出在法律制度層面上的能夠適當應對微博侵權(quán)的維權(quán)出路。
[Abstract]:With the birth of Weibo, a new medium, the corresponding instant and fragmented forms of information dissemination quickly entered the public's view. Weibo not only changed people's lives, but also brought about a new pattern of infringing behavior. This kind of infringing on people's names and portraits, which is generated by the operation of Weibo, The infringement of rights and interests such as honor and even copyright occurs more quickly. This brings new problems to the traditional methods of defending rights in judicial practice. These problems are embodied in the traditional litigation procedure in judicial practice to deal with infringement cases caused by Weibo's infringement. Repeated embarrassment in the trial, On the other hand, because of the characteristics of Weibo's infringement, we need to find a new breakthrough point in the prevention if we want to protect the rights of Weibo's tort. This article is based on discussing and summing up the many manifestations and new characteristics of the infringement of Weibo. This paper analyzes the plight of Weibo's torts and the corresponding institutional causes, in order to find out the right way out of the legal system which can properly deal with the infringement of Weibo's rights.
