【摘要】：主要論述了知識(shí)產(chǎn)權(quán)國際保護(hù)中的權(quán)利平衡問題。首先解釋了知識(shí)產(chǎn)權(quán)和知識(shí)產(chǎn)權(quán)國際保護(hù)的概念、特征和范圍,其次對(duì)權(quán)力平衡進(jìn)行了法理層面的分析和闡釋,然后分別從國內(nèi)法角度和國際法角度對(duì)當(dāng)今國際知識(shí)產(chǎn)權(quán)保護(hù)中的權(quán)利失衡問題進(jìn)行討論,最后總結(jié)了重建國際知識(shí)產(chǎn)權(quán)權(quán)利平衡的一些對(duì)策和建議。我國作為最大的發(fā)展中國家,理應(yīng)借鑒發(fā)達(dá)國家的成熟經(jīng)驗(yàn),大力推進(jìn)我國知識(shí)產(chǎn)權(quán)制度的發(fā)展,促進(jìn)國際知識(shí)產(chǎn)權(quán)保護(hù)制度的完善與合理化。
[Abstract]:This paper mainly discusses the balance of rights in the international protection of intellectual property rights. Firstly, it explains the concept, characteristics and scope of the international protection of intellectual property rights and intellectual property rights, and then analyzes and interprets the balance of power from the perspective of legal theory. Then, from the angle of domestic law and international law, respectively, the issue of the imbalance of rights in the protection of international intellectual property rights is discussed. Finally, some countermeasures and suggestions for rebuilding the balance of international intellectual property rights are summarized. As the largest developing country, China should learn from the mature experience of developed countries and vigorously promote the development of China's intellectual property system. To promote the improvement and rationalization of the international intellectual property protection system.
