【摘要】：隨著我國資本市場改革的深入進行和金融領域的進一步發(fā)展,以及我國金融商品與服務的創(chuàng)新程度和水平的不斷提升,我國金融消費者群體也隨之逐漸壯大起來,金融交易糾紛的數(shù)量也隨之迅速攀升。因此就出現(xiàn)了很多金融交易糾紛類的法律案件,但是由于我國相關法律規(guī)定很少,導致法院的判決不一致。這些案件不僅僅關系到金融消費者的合法權益,而且對今后的金融市場秩序有一定的引導作用,也會影響到金融穩(wěn)定和安全。各個國家紛紛采取立法的形式來加強對金融消費者權益的保護,這在世界上形成了一種保護金融消費者合法權益的立法趨勢,與此同時加強對我國金融消費者權益的保護并建立和完善適合我國國情的金融消費者權益保護制度成為重大課題。本文以加強對我國金融消費者權益的保護作為論證的核心。首先通過對金融消費者這個基本概念的界定,說明保護主體,厘清邏輯論證的起點。在此基礎上明確金融消費者權利的內容,明確保護客體。在此前提下,本文較為全面的分析了我國金融消費者權益保護的立法現(xiàn)狀、實踐當中存在的問題及實踐中有利于金融消費者權益保護的有益探索。然后對于日本的金融消費者權益保護制度進行了較為深入的分析,并總結其保護經(jīng)驗。然后對于中日兩國的金融消費者權益保護制度進行了對比分析。最后結合我國實際情況在立法、金融監(jiān)管目標、統(tǒng)一保護機構體系、權利救濟機制和金融消費者教育等方面提出了完善我國金融消費者權益保護制度的建議。
[Abstract]:With the deepening of the capital market reform and the further development of the financial field, as well as the innovation degree and level of the financial goods and services, the financial consumer group in our country has gradually expanded. The number of financial transaction disputes is also rising rapidly. As a result, there have been many legal cases of financial transaction disputes, but there are very few relevant laws and regulations in our country. These cases not only concern the legitimate rights and interests of financial consumers, but also play a guiding role in the financial market order in the future. It will also affect financial stability and security. Various countries have taken the form of legislation to strengthen the protection of the rights and interests of financial consumers, which has formed a legislative trend in the world to protect the legitimate rights and interests of financial consumers. At the same time, strengthening the protection of the rights and interests of financial consumers in our country and establishing and perfecting the system of protecting the rights and interests of financial consumers suitable for the national conditions of our country has become an important subject. The core of the argument. First, through the definition of the basic concept of financial consumers, Explain the subject of protection, clarify the starting point of logical argumentation. On this basis, clear the content of financial consumer rights and clear protection of the object. On this premise, this paper comprehensively analyzes the current legislative situation of the protection of the rights and interests of financial consumers in China. The problems existing in practice and the beneficial exploration in practice conducive to the protection of the rights and interests of financial consumers. Then, it makes a more in-depth analysis of Japan's financial consumer rights and interests protection system. And summarizes its protection experience. Then carries on the comparative analysis to the financial consumer rights and interests protection system of China and Japan. Finally unifies the protection organization system in the legislation, the financial supervision target, the unifying protection institution system combining the actual situation of our country, The rights relief mechanism and financial consumer education are put forward to perfect the financial consumer rights protection system in China.
