【摘要】：二十一世紀(jì),信息產(chǎn)業(yè)發(fā)展日新月異,人類(lèi)社會(huì)大踏步向信息化時(shí)代邁進(jìn),個(gè)人信息成為一種重要的社會(huì)資源。個(gè)人參與社會(huì)活動(dòng)過(guò)程中將個(gè)人信息留存在了商場(chǎng)、銀行、行政機(jī)關(guān)等等各個(gè)領(lǐng)域,個(gè)人信息在不經(jīng)意間被收集、存儲(chǔ)、傳輸、處理和利用。對(duì)個(gè)人信息的保護(hù),作為一個(gè)全球性的法律問(wèn)題,己經(jīng)引起越來(lái)越多的關(guān)注。在此,本文討論未成年人的個(gè)人信息保護(hù)問(wèn)題,是基于未成年人群體的特殊性,其個(gè)人信息較之成年人更具有社會(huì)意義,保護(hù)得當(dāng)可以促使社會(huì)對(duì)未成年人的保護(hù)問(wèn)題更加關(guān)注,使未成年人的身心、思想、智力等方面健康發(fā)展,最終成長(zhǎng)為合格的社會(huì)人。除引言和結(jié)語(yǔ)外,本文分四個(gè)部分:第一部分是對(duì)未成年人個(gè)人信息的界定以及對(duì)未成年人個(gè)人信息法律保護(hù)的特殊性的強(qiáng)調(diào)。其中厘清了個(gè)人信息和未成年人個(gè)人信息的概念,對(duì)未成年人個(gè)人信息的特殊性進(jìn)行了分析。第二部分是對(duì)未成年人個(gè)人信息保護(hù)的現(xiàn)狀分析,以及法律保護(hù)的必要性分析。通過(guò)分析我國(guó)目前未成年人個(gè)人信息保護(hù)的立法現(xiàn)狀,總結(jié)出未成年人個(gè)人信息法律保護(hù)方面存在的問(wèn)題,最后從四個(gè)方面強(qiáng)調(diào)了未成年人個(gè)人信息法律保護(hù)的必要性。第三部分為我國(guó)未成年人個(gè)人信息法律保護(hù)的域外法考察,分析了美國(guó)、英國(guó)、德國(guó)和日本的未成年個(gè)人信息法律保護(hù)概況,為我國(guó)的未成年人個(gè)人信息法律保護(hù)提供了啟示和參考。第四部分基于前文的綜合分析提出完善我國(guó)未成年人個(gè)人信息法律保護(hù)的思考,包括我國(guó)應(yīng)采取的立法模式、法律保護(hù)制度構(gòu)建等。
[Abstract]:In 21th century, the information industry develops with each passing day, the human society stride forward to the information age, the personal information becomes an important social resource. Personal information is collected, stored, transmitted, processed and used inadvertently. As a global legal issue, the protection of personal information has attracted more and more attention. This paper discusses the protection of minors' personal information, which is based on the particularity of minors' group. The personal information of minors is of more social significance than that of adults. Proper protection can make the society pay more attention to the protection of minors. Make the minor's body, mind, intelligence and so on healthy development, finally grow into qualified social person. Except introduction and conclusion, This paper is divided into four parts: the first part is the definition of minors' personal information and the emphasis on the particularity of the legal protection of minors' personal information, which clarifies the concepts of personal information and minors' personal information. This paper analyzes the particularity of minors' personal information. The second part is the analysis of the current situation of the protection of minors' personal information. And the necessity of legal protection. Through the analysis of the current situation of legislation on the protection of minors' personal information in our country, the problems in the legal protection of minors' personal information are summarized. Finally, it emphasizes the necessity of the legal protection of minors' personal information from four aspects. The third part is the investigation of the extraterritorial laws on the legal protection of minors' personal information in China, and analyzes the United States, the United Kingdom, the United States and the United Kingdom. A Survey of the legal Protection of underage personal Information in Germany and Japan, It provides enlightenment and reference for the legal protection of minors' personal information in our country. Part 4th, based on the comprehensive analysis above, puts forward some thoughts on how to perfect the legal protection of minors' personal information in China, including the legislative model that should be adopted in our country.
