【摘要】：將財(cái)產(chǎn)分為物質(zhì)財(cái)產(chǎn)與非物質(zhì)財(cái)產(chǎn)具有邏輯周延性,而將財(cái)產(chǎn)分為有形財(cái)產(chǎn)與無(wú)形財(cái)產(chǎn)則欠缺邏輯周延性。對(duì)非物質(zhì)利益的法律保護(hù)形成非物質(zhì)財(cái)產(chǎn)權(quán)制度,而非物質(zhì)財(cái)產(chǎn)的范圍,從初起的知識(shí)財(cái)產(chǎn),到現(xiàn)在的虛擬財(cái)產(chǎn),再到將來(lái)的信息財(cái)產(chǎn),經(jīng)歷了從無(wú)到有、從少到多的漸進(jìn)過(guò)程。通過(guò)語(yǔ)用分析,研究認(rèn)為非物質(zhì)財(cái)產(chǎn)包括信息財(cái)產(chǎn)與其他非物質(zhì)財(cái)產(chǎn),信息財(cái)產(chǎn)進(jìn)而包括知識(shí)財(cái)產(chǎn)、虛擬財(cái)產(chǎn)與其他信息財(cái)產(chǎn)。
[Abstract]:The division of property into material property and intangible property has logical periodicity, while the division of property into tangible property and intangible property is lack of logical periodicity. The legal protection of immaterial interests forms the system of immaterial property rights. The scope of non-material property, from the initial knowledge property, to the present virtual property, and then to the future information property, has gone through a gradual process from nothing to existence, from little to much. It is concluded that immaterial property includes information property and other immaterial property, information property includes knowledge property, virtual property and other information property.
