【摘要】：研究各國民事責任體系的發(fā)展歷程,都可以得出這樣一個結(jié)論,那就是補償性賠償制度在各國的民事責任體系中都扮演著最為重要的角色,相對應(yīng)地,懲罰性賠償制度的發(fā)展歷程幾經(jīng)曲折,并且在各國的民事責任體系中都處于被輕視或忽視的狀態(tài)。在我國,對于懲罰性賠償制度的討論從未停止過,并且爭議相當大。伴隨著我國社會經(jīng)濟的持續(xù)性發(fā)展,各種社會性問題逐漸轉(zhuǎn)變?yōu)榉蓡栴},如環(huán)境問題和反壟斷問題等。為更合理地論述本文,首先就懲罰性賠償?shù)幕靖拍�、性質(zhì)和功能等方面進行了論述,并且結(jié)合我國的法律規(guī)定,較為具體地闡述了當前我國法律對該制度的規(guī)定。同時,結(jié)合實務(wù)中所存在的適用性問題,較為清晰地闡述了該制度在適用范圍、賠償金的設(shè)置、構(gòu)成要件和法官的自由裁量權(quán)四個方面所存在的問題。結(jié)合當前的法律規(guī)定、司法實務(wù)中所存在的問題和社會經(jīng)濟的發(fā)展需要,本文第三章第三節(jié)論述了該制度應(yīng)該擴大其適用范圍,以期社會和公民的合法權(quán)益能得到更好地維護。在研究該制度的過程中,本文運用了多種方法,如經(jīng)濟分析法、比較分析法、歷史分析法等,從多個方面就該制度進行了闡述。在研讀其他學(xué)者關(guān)于該制度的論著外,本文在該制度的適用范圍章節(jié),分析了可擴張適用的情形,作為本文的創(chuàng)新之處。
[Abstract]:After studying the development of civil liability system in various countries, we can draw the conclusion that compensatory compensation system plays the most important role in the civil liability system of various countries, corresponding to it. The development of punitive damages system has been tortuous, and in the civil liability system of all countries are in the state of being despised or ignored. In our country, the discussion of punitive damages system has never stopped. With the sustainable development of our country's social economy, various social problems have gradually changed into legal problems, such as environmental problems and antitrust issues. First of all, the basic concept, nature and function of punitive damages are discussed, and combined with the legal provisions of our country, more specific elaboration of the current law of this system. At the same time. Combined with the applicability of the practical problems, the system in the scope of application, compensation set more clearly. Combined with the current legal provisions, the problems existing in the judicial practice and the needs of social and economic development. The third section of this paper discusses that the system should expand its scope of application so that the legitimate rights and interests of society and citizens can be better safeguarded. In the process of studying the system, this paper uses a variety of methods. Such as economic analysis, comparative analysis, historical analysis and so on, from a number of aspects to elaborate the system. In addition to the study of other scholars on the system, this article in the application of the system section. This paper analyzes the extensible application of the case, as the innovation of this paper.
