【摘要】：新增規(guī)避3D打印機(jī)給料限制技術(shù)措施的臨時(shí)例外是美國(guó)DMCA試圖激勵(lì)3D打印領(lǐng)域的技術(shù)創(chuàng)新、平衡3D打印企業(yè)與消費(fèi)者之間利益的一種立法嘗試。文章分析各利益方圍繞非侵權(quán)性使用、不利影響和法定因素展開(kāi)的博弈,解讀該條款的假定、行為模式、法律后果。規(guī)避3D打印機(jī)給料限制技術(shù)措施的行為不被認(rèn)定為版權(quán)法上的侵權(quán)應(yīng)同時(shí)滿足:以使用替代材料進(jìn)行3D打印為實(shí)施規(guī)避行為的唯一目的;不實(shí)施任何旨在獲取存儲(chǔ)于3D打印機(jī)中的其他專有數(shù)據(jù)的行為;不以具備打印商業(yè)產(chǎn)品或材料能力的3D打印機(jī)給料限制技術(shù)措施為規(guī)避行為的實(shí)施對(duì)象等條件。我國(guó)可考慮增加對(duì)規(guī)避3D打印給料限制技術(shù)措施行為的豁免規(guī)定、加強(qiáng)對(duì)3D設(shè)計(jì)文件的版權(quán)監(jiān)管及簽發(fā)"版權(quán)申明標(biāo)志"。
[Abstract]:The new temporary exception to the technical measures to circumvent the feeding restrictions of 3D printers is the attempt by the United States DMCA to stimulate technological innovation in the field of 3D printing. A legislative attempt to balance the interests of 3D printing enterprises and consumers. This paper analyzes the game of non-infringing use, adverse effects and legal factors, and interprets the assumptions and behavior patterns of this clause. Legal consequences. The act of circumventing the technical measures of restricting the supply of 3D printer should not be considered as infringement of copyright law: the only purpose of the circumvention is to use the substitute material for 3D printing; Does not perform any act aimed at obtaining other proprietary data stored in a 3D printer; It is not necessary to take the technical measures of 3D printer feeding which have the ability to print commercial products or materials as the object of circumvention. Our country may consider increasing the exemption of the technical measures to circumvent the 3D printing feed restrictions. The rules. Strengthen the copyright control of 3D design documents and issue "copyright declaration logo".
