【摘要】：通過文獻分析將逾期竣工違約金的確定問題分解為違約金的約定和約定過高情況下的調整兩個方面;分析發(fā)包人在約定逾期竣工違約金時應考慮的因素及約定的兩種方式,具體研究不同方式下違約金金額的確定。最后,通過整理相關法律文件明確約定過高情況下逾期竣工違約金調整的兩個基本原則,并據(jù)此將逾期竣工違約金的調整分為實際損失可計量與不可計量兩種情況并作具體考慮。
[Abstract]:Based on the analysis of literature , the determination of overdue liquidated damages is decomposed into two aspects : the agreement of the liquidated damages and the adjustment of the agreement . The two basic principles for the adjustment of the liquidated damages in different ways are discussed in detail through the analysis of the factors and the agreements which the Employer should take into account when the overdue liquidated damages are agreed . Finally , the adjustment of overdue liquidated damages is divided into two basic principles of actual loss , measurable and non - measurable .
