作為邏輯思維的重要體現(xiàn)，主位推進模式不僅決定了立法語篇的構(gòu)成，而且決定了語篇信息結(jié)構(gòu)的分布。本篇論文以1979年7月1日第五屆全國人民代表大會第二次會議通過,1997年3月14日第八屆全國人民代表大會第五次會議修訂的《中華人民共和國刑法》作為語料樣本，將452條，752款按照性質(zhì)型命題，定義型命題，規(guī)范型命題，準(zhǔn)用型命題，陳述型命題分為五大類，分別研究分析每一類型命題的語篇構(gòu)成，主位推進模式，及其信息結(jié)構(gòu)的分布。雖然大陸法系與英美法系存在異質(zhì)性，但是在立法語篇層面都嚴(yán)格遵循著語篇的邏輯性規(guī)則，立法語篇中的邏輯性主要體現(xiàn)在立法文本的構(gòu)成上，無論是宏觀層面還是微觀層面邏輯無處不在，為了使語篇連貫通順，不僅大量使用邏輯聯(lián)結(jié)詞，而且在語篇信息結(jié)構(gòu)的分布上也嚴(yán)格遵循著邏輯思維。由于英漢兩種語言在語言組織結(jié)構(gòu)和表達法上的根本差異，導(dǎo)致了在立法語篇文本構(gòu)成上體現(xiàn)著不同的邏輯思維。這對譯文的準(zhǔn)確性及忠實度提出了更高的要求，不僅要準(zhǔn)確譯出原文的意義和立法意圖，更重要的是達到與原語等同的法律效果。在立法文本的英譯過程中，如何在準(zhǔn)確傳達原文意義和立法意圖的基礎(chǔ)上實現(xiàn)邏輯思維的成功轉(zhuǎn)換成為評價譯文質(zhì)量的重要標(biāo)...
