以實(shí)現(xiàn)和諧的人事關(guān)系為目標(biāo) 努力完善我國(guó)人事?tīng)?zhēng)議仲裁制度

【摘要】:從1995年人事部正式提出建立人事?tīng)?zhēng)議仲裁制度,到2003年最高人民法院發(fā)布《關(guān)于人民法院審理事業(yè)單位人事?tīng)?zhēng)議案件若干問(wèn)題的規(guī)定》,經(jīng)過(guò)十多年的發(fā)展,我國(guó)人事?tīng)?zhēng)議仲裁制度框架體系已得到了初步確立,并實(shí)現(xiàn)了與司法制度的接軌。進(jìn)入新世紀(jì)新階段,黨中央提出了構(gòu)建社會(huì)主義和諧社會(huì)、人才強(qiáng)國(guó)等一系列戰(zhàn)略目標(biāo),要求妥善協(xié)調(diào)各方面的利益關(guān)系,正確處理人民內(nèi)部矛盾。中共中央、國(guó)務(wù)院《關(guān)于進(jìn)一步加強(qiáng)人才工作的決定》也明確提出要“完善人事?tīng)?zhēng)議仲裁制度”。今年正式實(shí)施的《公務(wù)員法》首次以國(guó)家法律的形式, 提出了“國(guó)家建立人事?tīng)?zhēng)議仲裁制度”,進(jìn)一步明確了人事?tīng)?zhēng)議仲裁制度的法律地位。這些都為完善人事?tīng)?zhēng)議仲裁制度指明了方
[Abstract]:From the official proposal by the Ministry of personnel in 1995 to establish an arbitration system for personnel disputes, to the issuance in 2003 by the Supreme people's Court of provisions on certain issues concerning the trial of personnel disputes in Public institutions by the people's Court, after more than ten years of development, Our country personnel dispute arbitration system frame system has been established preliminarily, and has realized the connection with the judicial system. Entering a new stage in the new century, the CPC Central Committee has put forward a series of strategic objectives, such as building a socialist harmonious society, strengthening the country with talents, and so on, requiring proper coordination of the interests of all sides, and correct handling of the contradictions among the people. The decision of the CPC Central Committee and the State Council to further strengthen the work of personnel also explicitly proposes to "perfect the arbitration system of personnel disputes." The Civil Service Law, which was formally implemented this year, for the first time in the form of national law, put forward the "Establishment of personnel dispute Arbitration system by the State", which further clarified the legal status of the personnel dispute Arbitration system. All of these points out the way to perfect the arbitration system of personnel dispute.
