【摘要】：盡管中國法律對勞動者的權(quán)利作出了詳盡的規(guī)定,但勞動者的權(quán)利并沒有得到真正落實(shí)。在勞動力市場上,勞動者自由簽約的權(quán)利僅是一種法律意義上的自由選擇,而不是實(shí)質(zhì)性的自由選擇。原因在于勞動者除了出讓自己的勞動力之外,并沒有其他選擇。勞動者要真正能夠?qū)崿F(xiàn)自由平等選擇,除了獲得平等的法定權(quán)利之外,還必須擁有其他選擇機(jī)會。這就要求勞動者必須擁有一系列平等權(quán)利,包括經(jīng)濟(jì)權(quán)利、政治權(quán)利、社會權(quán)利。勞動者在獲得了這些權(quán)利之后,在消極意義上可以選擇退出勞動力市場,在積極意義上可以選擇其他勞動機(jī)會,從而才能夠?qū)崿F(xiàn)實(shí)質(zhì)性的平等。構(gòu)建城鄉(xiāng)統(tǒng)一的勞動力市場,應(yīng)該從真正完善勞動者的系列權(quán)利入手。
[Abstract]:Although Chinese law provides for the rights of workers in detail, the rights of workers are not really implemented. In the labor market, the right of workers to sign freely is only a free choice in the sense of law, not a substantial free choice. The reason is that workers have no choice but to make their own workforce. In order for workers to be able to choose freely and equally, they must have other choices besides equal legal rights. This requires workers to have a range of equal rights, including economic rights, political rights, social rights. After obtaining these rights, workers can choose to withdraw from the labor market in a negative sense, and can choose other labor opportunities in a positive sense, so that they can achieve substantive equality. The construction of a unified labor market in urban and rural areas should begin with the real perfection of workers' rights.
