【摘要】：改革開(kāi)放以來(lái),隨著公共所有制企業(yè)改制的不斷推進(jìn)、私營(yíng)企業(yè)的發(fā)展壯大及勞動(dòng)者維權(quán)意識(shí)的不斷增強(qiáng),勞動(dòng)保障監(jiān)察面臨更多的挑戰(zhàn)。如何進(jìn)一步創(chuàng)新監(jiān)管手段和方式,優(yōu)化勞動(dòng)保障監(jiān)察執(zhí)法水平,提升辦案效率,最大程度地促進(jìn)勞動(dòng)保障法律法規(guī)得到貫徹落實(shí),切實(shí)維護(hù)勞動(dòng)者權(quán)益,是新形勢(shì)下勞動(dòng)保障監(jiān)察工作面臨的新課題。2009年開(kāi)始,政府審時(shí)度勢(shì),開(kāi)展勞動(dòng)保障監(jiān)察“兩網(wǎng)化”的探索和建設(shè)。勞動(dòng)保障監(jiān)察信息系統(tǒng)的設(shè)立,滿足了勞動(dòng)保障監(jiān)察快速處理案件、落實(shí)科學(xué)監(jiān)管、風(fēng)險(xiǎn)預(yù)防和宏觀決策等要求,較好地解決了勞動(dòng)保障監(jiān)察監(jiān)管被動(dòng)缺位、案件處理效率不高等問(wèn)題,幫助勞動(dòng)保障監(jiān)察單位實(shí)現(xiàn)了對(duì)監(jiān)管對(duì)象的動(dòng)態(tài)化、信息化、全面化監(jiān)管,為規(guī)范用人單位遵守勞動(dòng)保障管理制度、及時(shí)追究各種違法行為提供了很大便利。本文以長(zhǎng)沙地區(qū)基層勞動(dòng)保障監(jiān)察狀況入手,探討勞動(dòng)保障監(jiān)察“兩網(wǎng)化”建設(shè)的時(shí)代背景和地域背景,以及制度實(shí)施對(duì)勞動(dòng)保障監(jiān)察工作帶來(lái)的影響,并根據(jù)調(diào)查結(jié)果提出針對(duì)性的建議。基層勞動(dòng)保障監(jiān)察“兩網(wǎng)化”建設(shè),實(shí)現(xiàn)了勞動(dòng)保障監(jiān)察信息系統(tǒng)與空間信息系統(tǒng)相鏈接,能夠使勞動(dòng)監(jiān)管機(jī)關(guān)實(shí)時(shí)直觀地掌握最新動(dòng)態(tài)以及用人單位等違反勞動(dòng)保障法律法規(guī)行為的情況,加大了侵害勞動(dòng)者權(quán)益行為的查處力度。勞動(dòng)保障監(jiān)察空間信息系統(tǒng)的創(chuàng)建,實(shí)現(xiàn)了勞動(dòng)保障監(jiān)察工作手段和工具的創(chuàng)新,借助計(jì)算機(jī)等工具加強(qiáng)勞動(dòng)保障監(jiān)察力度,實(shí)時(shí)采集網(wǎng)格區(qū)域內(nèi)用人單位用工、勞動(dòng)合同簽訂、社會(huì)保險(xiǎn)購(gòu)買、工資按時(shí)支付、工作安全條件等信息,實(shí)施動(dòng)態(tài)監(jiān)控,建立起嚴(yán)密的監(jiān)控體系,全覆蓋、全過(guò)程監(jiān)督檢查的新型勞動(dòng)保障監(jiān)察機(jī)制,及時(shí)掌控用人單位用工信息,實(shí)現(xiàn)科學(xué)分類、動(dòng)態(tài)監(jiān)管,預(yù)防和有效查處各類勞動(dòng)侵權(quán)違法行為,自推行以來(lái)取得了良好的社會(huì)效果。但同時(shí),勞動(dòng)保障監(jiān)察領(lǐng)域“以罰代管”依舊盛行,基層執(zhí)法力量薄弱、財(cái)政投入不足,勞動(dòng)保障監(jiān)察手段、制度亟待創(chuàng)新等依舊制約著勞動(dòng)保障監(jiān)察“兩網(wǎng)化”建設(shè)的步伐。
[Abstract]:Since the reform and opening up, with the continuous promotion of the reform of the public ownership enterprises, the development and expansion of private enterprises and the continuous strengthening of workers' awareness of protecting their rights, labor security supervision is facing more challenges. How to further innovate the means and methods of supervision, optimize the level of labor security supervision and law enforcement, improve the efficiency of handling cases, maximize the implementation of labor security laws and regulations, and earnestly safeguard the rights and interests of workers, It is a new task that the labor security supervision work faces under the new situation. Since 2009, the government has reviewed the situation and carried out the exploration and construction of the "two networks" of the labor security supervision. The establishment of labor security supervision information system satisfies the demands of labor security supervision to deal with cases quickly, implement scientific supervision, risk prevention and macro decision-making, and solve the passive absence of labor security supervision and supervision. The inefficient handling of cases has helped the labor security supervision units to realize the dynamic, informational and comprehensive supervision of the objects of supervision, in order to standardize the employers' compliance with the labor security management system. Prompt investigation of various illegal acts has provided great convenience. Starting with the situation of labor security supervision at the grass-roots level in Changsha, this paper probes into the background of the construction of "two networks" of labor security supervision and the regional background, as well as the influence of the implementation of the system on the work of labor security supervision. And according to the results of the investigation put forward targeted recommendations. The construction of "two networks" for grass-roots labor security supervision has realized the link between the labor security supervision information system and the spatial information system. It can make the labor supervision authorities grasp the latest trends and the situation of violating labor security laws and regulations in real time, and increase the investigation and punishment of violations of workers' rights and interests. The establishment of the labor security supervision spatial information system has realized the innovation of the labor security supervision work means and tools, strengthened the labor security supervision by means of computer and other tools, and collected the employing units in the grid area in real time. The signing of labor contracts, the purchase of social insurance, the timely payment of wages, the working safety conditions, and other information, the implementation of dynamic monitoring, the establishment of a strict monitoring system, the full coverage, the whole process of supervision and inspection of a new type of labor security supervision mechanism, It has achieved good social effect since it was implemented by controlling the employment information of the employing unit in time, realizing scientific classification, dynamic supervision, preventing and effectively investigating and punishing all kinds of illegal labor infringement. But at the same time, the field of labor security supervision is still popular, the basic law enforcement force is weak, the financial input is insufficient, the labor security supervision means, the system needs to be innovated and so on, which still restricts the construction of the labor security supervision "two nets".
