【摘要】: 作為全球化浪潮的產(chǎn)物,社會(huì)責(zé)任運(yùn)動(dòng)對(duì)我國(guó)經(jīng)濟(jì)、社會(huì)制度產(chǎn)生了巨大沖擊,這是我國(guó)正在面對(duì)的不可回避的客觀現(xiàn)實(shí)。但是,企業(yè)社會(huì)責(zé)任運(yùn)動(dòng)在我國(guó)基本上處于放任的狀態(tài),超然于法律視野之外,作為這一運(yùn)動(dòng)的直接產(chǎn)物——跨國(guó)公司制訂的生產(chǎn)守則,對(duì)中國(guó)經(jīng)濟(jì)和社會(huì)產(chǎn)生巨大影響的同時(shí),同樣也沒有納入中國(guó)的勞動(dòng)法制的框架內(nèi)。生產(chǎn)守則作為一種企業(yè)內(nèi)部規(guī)章制度,是企業(yè)社會(huì)責(zé)任運(yùn)動(dòng)的積極成果,是跨國(guó)公司承擔(dān)社會(huì)責(zé)任的承諾書,對(duì)于它的積極方面,應(yīng)該鼓勵(lì)和發(fā)揚(yáng);但是,生產(chǎn)守則如果得不到有效監(jiān)督和制約,往往是一紙空文,成為跨國(guó)公司的公關(guān)工具和發(fā)達(dá)國(guó)家實(shí)行貿(mào)易保護(hù)的工具。因此,必須將社會(huì)責(zé)任運(yùn)動(dòng)和跨國(guó)公司生產(chǎn)守則運(yùn)動(dòng)納入法制軌道。本文從分析生產(chǎn)守則的法律性質(zhì)出發(fā),揭示了其效力來源;在考察生產(chǎn)守則的外部效力對(duì)我國(guó)經(jīng)濟(jì)和法制建設(shè)的影響的基礎(chǔ)上,提出了將其納入我國(guó)法制軌道的具體建議。 本文的主要?jiǎng)?chuàng)新點(diǎn)在于:首先,對(duì)生產(chǎn)守則的法律性質(zhì)進(jìn)行定性分析,指出其具有對(duì)內(nèi)和對(duì)外兩種不同的性質(zhì),生產(chǎn)守則的對(duì)外性質(zhì)是其產(chǎn)生廣泛影響的根本原因;另外,本文認(rèn)為,跨國(guó)公司具有道義上的優(yōu)勢(shì)、雄厚的經(jīng)濟(jì)實(shí)力和發(fā)達(dá)國(guó)家在政治上的支持,這是其制定的生產(chǎn)守則的效力根源所在;本文還以具體的生產(chǎn)守則文本為例進(jìn)行評(píng)述,將其與我國(guó)的勞動(dòng)法進(jìn)行比較,探尋跨國(guó)公司生產(chǎn)守則與我國(guó)勞動(dòng)法的契合點(diǎn)與沖突,這也是本文的創(chuàng)新點(diǎn)之一。 本文從勞動(dòng)法學(xué)的角度探討企業(yè)社會(huì)責(zé)任/生產(chǎn)守則問題,在我國(guó)勞動(dòng)者權(quán)益保護(hù)不力的情況下,無疑具有極強(qiáng)的現(xiàn)實(shí)意義,此為本文的貢獻(xiàn)之一。同時(shí),在中國(guó)勞動(dòng)法制面臨艱巨改革任務(wù)的今天,本文的研究對(duì)于明確全球化背景下中國(guó)勞動(dòng)法制未來的發(fā)展道路也具有一定的理論意義。另外,生產(chǎn)守則作為一種新生事物,并未被廣泛了解,如本文的出現(xiàn)可以讓大家進(jìn)一步了解、熟悉生產(chǎn)守則,那將也是本文的貢獻(xiàn)之一。
[Abstract]:As the product of globalization, the movement of social responsibility has had a great impact on the economy and social system of our country, which is an unavoidable objective reality that our country is facing. However, the CSR movement in our country is basically in a state of laissez-faire, which is detached from the legal field of view. As a direct product of this movement-the production code formulated by transnational corporations. China's economic and social impact, but also not included in the framework of China's labor law. As a kind of internal rules and regulations of enterprises, the code of production is the positive result of the corporate social responsibility movement and the undertaking of transnational corporations to assume social responsibility. The positive aspects of it should be encouraged and carried forward; however, If the code of production is not effectively supervised and restricted, it often becomes a public relations tool for multinational corporations and a tool for trade protection in developed countries. Therefore, the social responsibility movement and the multinational corporation code of conduct movement must be brought into the legal system orbit. Based on the analysis of the legal nature of the code of production, this paper reveals the source of its effectiveness and, on the basis of examining the influence of the external effectiveness of the code on the economic and legal construction of our country, puts forward some concrete suggestions for bringing it into the track of our country's legal system. The main innovations of this paper are as follows: firstly, the qualitative analysis of the legal nature of the code of production is carried out, pointing out that it has two different properties, internal and external, and that the external nature of the code of production is the fundamental cause of its extensive influence. This paper holds that multinational corporations have moral advantages, strong economic strength and the political support of developed countries, which is the root of the effectiveness of their codes of production. Comparing it with the labor law of our country, it is one of the innovative points of this paper to explore the agreement and conflict between the production code of multinational corporation and the labor law of our country. This paper discusses the problem of corporate social responsibility (CSR) / code of production from the angle of labor law, which is undoubtedly of great practical significance under the circumstance of weak protection of workers' rights and interests in our country, which is one of the contributions of this paper. At the same time, at a time when China's labor legal system is facing the arduous task of reform, the research in this paper has certain theoretical significance for the future development of China's labor legal system under the background of globalization. In addition, the code of production as a new thing, has not been widely understood, such as the emergence of this article can let you further understand, familiar with the production code, that will be one of the contributions of this paper.
