農民工勞動權的法律保護探析

【摘要】:農民工是自80年代以來涌現(xiàn)的農村剩余勞動力向城鎮(zhèn)轉移而形成的一個特殊的社會群體。據(jù)國家統(tǒng)計局調查,目前我國農民工人數(shù)已經超過2億。由于我國長期以來形成的城鄉(xiāng)二元分割體制,造成農民工職業(yè)與身份的不一致性。從職業(yè)上看,農民工已不再是從事農業(yè)生產的農民,而是在城市從事第二、三產業(yè)的工人,但從身份上看,他們仍然是農民,因為他們的戶籍還在農村。這種不一致性導致農民工在工作以及工作以外的諸多方面遭受著不平等的待遇,使得他們的許多合法權益得不到真正的保障。如何解決農民工所面臨的這一系列問題,近年來,社會學者對此論述較多,而法學界則關注不夠。本文試從法學的角度對農民工權利保護中的一個突出問題——農民工的勞動權進行深入探討。 本文共分為三大部分: 第一部分:農民工與勞動權概述。首先對農民工進行了界定。接下來從概念、性質和內容三方面對勞動權作了全面梳理。最后論述了保護農民工勞動權的意義,指出保護農民工的勞動權是人權的內在要求、是遵守國際勞工標準的要求、是構建社會主義和諧社會的應有之義。 第二部分:農民工勞動權的現(xiàn)狀及其法律原因分析。首先從農民工的就業(yè)權受到嚴重侵害、勞動報酬權嚴重受損、休息休假權得不到保障、勞動安全衛(wèi)生權嚴重缺失、女職工和未成年工的特殊保護權未實現(xiàn)、職業(yè)培訓權難得到保障、社會保險權嚴重缺失、勞動權受侵后得不到及時救濟、維權組織缺失九個具體方面對農民工勞動權的現(xiàn)狀作了描述。其間引用大量數(shù)據(jù)和調研資料作為實證。緊接著對農民工勞動權缺失的法律原因進行了理論分析,對其中的立法、執(zhí)法和司法因素作了較深入的探討。 第三部分:加強農民工勞動權法律保護的思考。首先提出農民工勞動權保護的兩個原則——法律平等保護原則和法律特殊保護原則。嘗試從法理的高度論述農民工勞動權法律保護的理念。接著借鑒國外在解決相關問題上的經驗做法,,進行了比較研究。最后提出加強農民工勞動權法律保護的五條具體思路:一是要完善立法;二是要轉變政府職能,加強勞動執(zhí)法;三是要改革和完善勞動爭議處理機制:四是要提高農民工的組織化程度;最后要為農民工提供法律援助和普法宣傳。
[Abstract]:Migrant workers are a special social group formed by the shift of rural surplus labor force to cities and towns since 1980's. According to the National Bureau of Statistics survey, the number of migrant workers in China has exceeded 200 million. Because of the dualistic system of urban-rural division, the occupation and identity of migrant workers are inconsistent. From a professional point of view, migrant workers are no longer farmers engaged in agricultural production, but workers in the second and third industries in cities, but they are still peasants in terms of status, because their household registration is still in the countryside. Such inconsistency results in unequal treatment of migrant workers in many aspects of their work as well as outside of work, which makes many of their legitimate rights and interests not truly protected. In recent years, many social scholars have discussed how to solve this series of problems faced by migrant workers, but not enough in the field of law. In this paper, a prominent problem in the protection of the rights of migrant workers is discussed from the perspective of jurisprudence. This paper is divided into three parts: the first part: an overview of migrant workers and labor rights. First of all, the definition of migrant workers. Then the concept, nature and content of the three aspects of the overall combing of labor rights. Finally, it discusses the significance of protecting migrant workers' labor rights, and points out that the protection of migrant workers' labor rights is the inherent requirement of human rights and the requirement of complying with international labor standards. The second part: the status quo of migrant workers' labor rights and their legal reasons. First of all, the right to employment of migrant workers has been seriously violated, the right to remuneration has been seriously damaged, the right to rest and leave has not been guaranteed, the right to work safety and health has been seriously lacking, and the special protection rights of female workers and underage workers have not been realized. The right to vocational training is difficult to be guaranteed, the right to social insurance is seriously lacking, the right to work is not available for immediate relief after being invaded, and the current situation of migrant workers' labor rights is described in nine specific aspects of the absence of rights organizations. A large number of data and research materials are cited as empirical evidence. Then, the author makes a theoretical analysis of the legal reasons for the lack of migrant workers' labor rights, and probes into the legislative, law enforcement and judicial factors among them. Part three: the reflection on strengthening the legal protection of migrant workers' labor rights. Firstly, it puts forward two principles of labor rights protection of migrant workers-equal protection of law and special protection of law. This paper tries to discuss the concept of legal protection of migrant workers' labor rights from the perspective of legal theory. Then draw lessons from the experience of foreign countries in solving related problems, comparative study. Finally, five specific ideas for strengthening the legal protection of migrant workers' labor rights are put forward: one is to perfect the legislation, the other is to change the functions of the government and strengthen the labor law enforcement. Third, it is necessary to reform and improve the mechanism of handling labor disputes: fourth, to improve the degree of organization of migrant workers; finally, to provide legal aid and publicity for migrant workers.
