【摘要】：勞動力是一種特殊的生產(chǎn)要素和人力資本。作為勞動力的產(chǎn)權化形式,勞動力權是一種"內物權"性質的權利。勞動力權具有權利的天然"弱勢"性、權利價值的隱蔽性和人權屬性的基本特征。勞動力權是勞動權的基礎,以勞動權為價值表達和實現(xiàn)方式。勞動力權決定了勞動者人格的形成,其本身的從屬性決定了勞動權行使上的附屬性,進而決定了勞動關系的從屬性。勞動力權的雙重屬性要求強化勞動者在勞動關系中的主體地位,充分尊重"用工事實"本身的法律意義,勞動關系"不法"時仍應保護勞動者的既成利益。
[Abstract]:Labor force is a special factor of production and human capital. As a form of property right of labor force, labor right is a kind of property right. Labor right has the nature of "weakness" of right, the concealment of right value and the basic characteristic of human rights attribute. Labor right is the basis of labor right. The labor right determines the formation of the laborer's personality, and its subordinate attribute determines the accessory attribute of the exercise of the labor right, and then determines the subordinate attribute of the labor relations. The dual attribute of labor rights requires strengthening the principal position of laborers in labor relations, fully respecting the legal significance of "employment facts", and protecting the vested interests of workers when labor relations are "illegal".
