【摘要】： 作為制度事實(shí)而存在的社會(huì)法早已有之。隨著經(jīng)濟(jì)的發(fā)展、社會(huì)結(jié)構(gòu)的變革,社會(huì)法理論研究和制度建設(shè)也在不斷發(fā)展完善。社會(huì)法作為法體系的重要組成部分,是傳統(tǒng)法學(xué)的繼承,彌補(bǔ)了傳統(tǒng)法學(xué)的不足。而社會(huì)法特有的調(diào)整模式和實(shí)質(zhì)正義屬性,更是對(duì)傳統(tǒng)法學(xué)的超越。作為新興的市場(chǎng)經(jīng)濟(jì)國(guó)家,中國(guó)的社會(huì)法研究和制度實(shí)踐正在逐步展開(kāi)。中國(guó)官方和學(xué)術(shù)界對(duì)社會(huì)法治的問(wèn)題所展開(kāi)的實(shí)踐與探討,正逐步走向成熟。以勞動(dòng)法、社會(huì)保障法為核心的具有中國(guó)特色的社會(huì)法體系也在建設(shè)過(guò)程中。 本文研究的主要內(nèi)容包括三部分,具體如下： 首先,通過(guò)對(duì)既往社會(huì)法制度建設(shè)和理論研究的回顧與梳理,總結(jié)了中國(guó)社會(huì)法研究的歷史和實(shí)踐經(jīng)驗(yàn),重點(diǎn)從中國(guó)社會(huì)法的內(nèi)涵、外延、價(jià)值理念、制度事實(shí)等方面對(duì)其進(jìn)行了考察。 其次,在對(duì)中國(guó)社會(huì)法作出綜述的基礎(chǔ)上,本文在該部分內(nèi)容中分別對(duì)中國(guó)社會(huì)法歷史、理論和制度研究中所取得的成績(jī)作出評(píng)判,并從社會(huì)法總論和分論的角度對(duì)社會(huì)法研究中存在的主要問(wèn)題進(jìn)行重點(diǎn)分析。 最后,本文立足于國(guó)內(nèi)外社會(huì)法研究的經(jīng)驗(yàn)和總結(jié),對(duì)中國(guó)社會(huì)法理論研究的未來(lái)發(fā)展作出了自己的基本評(píng)判,并對(duì)中國(guó)社會(huì)法制度建設(shè)提出建議,以期為中國(guó)社會(huì)法治建設(shè)增磚添瓦。
[Abstract]:Social law, as a fact of the system, already exists. With the development of economy and the reform of social structure, the theoretical research and system construction of social law are constantly developing and perfecting. As an important part of the legal system, social law is the inheritance of the traditional jurisprudence and makes up for the deficiency of the traditional jurisprudence. The special adjustment mode and essence justice attribute of social law transcend the traditional law. As a new market economy country, China's social law research and system practice are being carried out step by step. The practice and discussion on the social rule of law in Chinese government and academia are gradually maturing. The social law system with Chinese characteristics with labor law and social security law as the core is also in the process of construction. The main contents of this paper include three parts, as follows: First of all, by reviewing and combing the past social law system construction and theoretical research, this paper summarizes the history and practical experience of Chinese social law research, focusing on the connotation, extension and value concept of Chinese social law. Institutional facts and other aspects of its investigation. Secondly, on the basis of the summary of Chinese social law, this paper evaluates the achievements in the history, theory and system of Chinese social law in this part. The main problems in the study of social law are analyzed emphatically from the perspective of social law general theory and division theory. Finally, based on the experience and summary of the study of social law at home and abroad, this paper makes its own basic judgment on the future development of the theoretical research of social law in China, and puts forward some suggestions for the construction of the system of social law in China. With a view to China's social construction of the rule of law to add bricks and tiles.
