【摘要】：正 我國鉛再生行業(yè)首例知識產權案——徐州有色金屬合金廠商業(yè)秘密被侵權一案,近日由江蘇省高級人民法院作出終審民事判決,維持徐州市中級人民法院的一審判決,認定原審被告河北省某廠侵犯原告徐州有色金屬合金廠商業(yè)秘密成立,依法判決賠償經濟損失30萬元。 徐州有色金屬合金廠被侵權案雖然得到了圓滿的解決,但留給人們的思考和啟示頗多。 啟示之一:企業(yè)法人要知法、懂法。企業(yè)法人對法一知半解,只知經濟合同法、新稅法、勞動法等常用法規(guī)還不行,還要學好技術合同法、反不正當競爭法、以及知識產權保護的有關法規(guī)等。
[Abstract]:The first case of intellectual property rights in the lead regeneration industry in China-the case of infringement of the commercial secrets of Xuzhou Nonferrous Metals Alloy Factory. Recently, the Jiangsu Provincial higher people's Court issued a final civil judgment to uphold the first instance judgment of the Xuzhou Intermediate people's Court. It was determined that a factory in Hebei Province had infringed on the commercial secrets of the plaintiff, Xuzhou Nonferrous Metal Alloy Factory, and awarded 300,000 yuan in compensation for economic losses according to law. Although the case of infringement of Xuzhou Nonferrous Metal Alloy Factory was satisfactorily resolved, But there are quite a lot of reflections and revelations left to people. One of the revelations is that enterprises legal persons should know the law and understand the law. The enterprise legal persons have a little knowledge of the law, only know the economic contract law, the new tax law, the labor law and other commonly used laws and regulations, but also learn the technical contract law well. Anti-unfair competition law, as well as intellectual property protection related laws and regulations.
