【摘要】： 本文是一篇關(guān)于貴陽(yáng)市“背篼工”及其權(quán)益保護(hù)問(wèn)題的實(shí)證研究。全文在借鑒前人研究成果的基礎(chǔ)上，主要以花溪區(qū)“背篼工”生存狀況為切入點(diǎn)，綜合運(yùn)用“制度化了的半工半耕過(guò)密型農(nóng)業(yè)生產(chǎn)理論”、“文化資本”、“底邊階層”、“社會(huì)排斥”等社會(huì)學(xué)理論和《中華人民共和國(guó)憲法》、《中華人民共和國(guó)勞動(dòng)法》、《國(guó)務(wù)院關(guān)于解決農(nóng)民工問(wèn)題的若干意見(jiàn)》等政策法規(guī)剖析了“背篼工”群體存在的原因、面臨的邊緣化處境及妥善解決這一問(wèn)題的意義。 本文第二章從“背篼工”整體收入水平低、時(shí)時(shí)面臨生存危機(jī)、常常遭受不法侵害等八個(gè)方面展現(xiàn)了他們所面臨的弱勢(shì)處境。在前述調(diào)查分析的基礎(chǔ)上，本文第三章運(yùn)用詹姆斯·C·斯科特、馬歇爾等學(xué)者的社會(huì)學(xué)理論及相關(guān)政策法規(guī)，從“背篼工”的生存權(quán)、工作權(quán)、社會(huì)權(quán)三個(gè)方面探析了他們?cè)诔擎?zhèn)社會(huì)所面臨的權(quán)益缺失狀況并淺析了其原因。 面對(duì)上述三種權(quán)利的缺失，本文第四章結(jié)合實(shí)際有針對(duì)性的提出了相應(yīng)的解決辦法。文中建議：“建立包括“背篼工”群體在內(nèi)的最低生活保障制度”以保障“背篼工”的生存權(quán)；從將“背篼工”納入城鎮(zhèn)職業(yè)介紹機(jī)構(gòu)公益服務(wù)范圍和積極開(kāi)展針對(duì)“背篼工”的對(duì)外勞務(wù)輸兩個(gè)方面入手，從而為“背篼工”搭建合理的就業(yè)平臺(tái)來(lái)保障他們的工作權(quán)；免費(fèi)實(shí)施對(duì)“背篼工”的教育培訓(xùn)以保障他們的社會(huì)權(quán)。 此外，文中還通過(guò)對(duì)羅爾斯《正義新論》中有關(guān)“機(jī)會(huì)平等與差別正義”相結(jié)合的原則和沈宗靈在《法理學(xué)》等著作中有關(guān)法律公正價(jià)值的闡述，深入分析了上述應(yīng)對(duì)措施是符合法律所追求的平等、正義原則的，，也是符合我國(guó)新世紀(jì)所極力倡導(dǎo)的制度價(jià)值的。
[Abstract]:This paper is an empirical study on the problem of "basket workers" and their rights and interests protection in Guiyang. Based on the previous research results, this paper mainly focuses on the living conditions of "basket workers" in Huaxi district. Comprehensive use of the "institutionalized theory of half-work and half-ploughing over dense agricultural production", "cultural capital", "bottom class", "social exclusion" and other sociological theories and the Constitution of the people's Republic of China. Policies and regulations such as the Labor Law of the people's Republic of China and the State Council's opinions on solving the problem of migrant workers have analyzed the reasons for the existence of the "basket carriers" group. The situation of marginalization and the significance of properly solving the problem.
