【摘要】：自從20世紀(jì)80年代我國(guó)引入招標(biāo)制度以來,在建筑領(lǐng)域內(nèi)這種制度得到了廣泛的運(yùn)用。這種制度的廣泛實(shí)行,對(duì)推動(dòng)我國(guó)建筑領(lǐng)域的發(fā)展有著非常重要的意義,但是不可否認(rèn)的是,隨著時(shí)代的發(fā)展,這種制度呈現(xiàn)出一定的弊端,導(dǎo)致工程中的違規(guī)行為也是層出不窮,比如投標(biāo)人圍標(biāo)串標(biāo),招標(biāo)人規(guī)避招標(biāo),監(jiān)管部門、行政主管部門審查不力,評(píng)標(biāo)專家接受他人賄賂等違規(guī)行為。這些違規(guī)行為的出現(xiàn)擾亂了我國(guó)的建筑市場(chǎng),給建筑市場(chǎng)的穩(wěn)定發(fā)展帶來了極其不利的影響。針對(duì)這些問題,筆者從工程中的違規(guī)行為出發(fā),首先分析這些違規(guī)行為的表現(xiàn)形式,分析了這種違規(guī)行為發(fā)生所帶來的危害性,然后運(yùn)用博弈理論的相關(guān)原理,從投標(biāo)人的串標(biāo)違規(guī)行為,招標(biāo)人的串標(biāo)違規(guī)行為,投標(biāo)人與監(jiān)督人的串標(biāo)行為和案例出發(fā),在歸納總結(jié)后認(rèn)為對(duì)經(jīng)濟(jì)利益的追逐,違法成本不高,相關(guān)法律不完善及監(jiān)督機(jī)制的不完善是違規(guī)行為出現(xiàn)的根本原因,最后給出了相應(yīng)的解決措施。同時(shí)在委托代理理論的體系下,對(duì)不同的參與主體之間的委托代理關(guān)系進(jìn)行分析,并針對(duì)招標(biāo)代理人、評(píng)標(biāo)人及招標(biāo)人分別進(jìn)行激勵(lì)機(jī)制、約束機(jī)制及監(jiān)督機(jī)制設(shè)計(jì),最后匯總出監(jiān)督機(jī)制存在的不足之處,根據(jù)這些不足之處,提出完善監(jiān)督機(jī)制的具體策略,達(dá)到減少違規(guī)行為的目的。當(dāng)然本論文也存在著諸多的不足之處:①本論文雖然對(duì)很多種違規(guī)行為進(jìn)行了分析,但是沒有針對(duì)一些具體的環(huán)節(jié)進(jìn)行更加深入的研究,是的某些違規(guī)行為在描述的過程中針對(duì)性不強(qiáng)②在運(yùn)用博弈論理論時(shí)也沒有深入的研究,同時(shí)在運(yùn)用博弈論的相關(guān)原理時(shí)只是針對(duì)串標(biāo)這一種違規(guī)行為進(jìn)行了描述,沒有多種違規(guī)行為進(jìn)行研究,使得到的結(jié)論針對(duì)性不強(qiáng);③在運(yùn)用委托代理理論時(shí)沒有從經(jīng)濟(jì)學(xué)的角度給出機(jī)制設(shè)計(jì)的數(shù)學(xué)模型,這也是研究過程中存在的不足;④對(duì)于監(jiān)督機(jī)制的研究沒有借鑒國(guó)外關(guān)于監(jiān)督機(jī)制的研究。
[Abstract]:Since the introduction of bidding system in China in 1980 s, this system has been widely used in the field of architecture. The extensive implementation of this system is of great significance to promote the development of the construction field in our country, but it is undeniable that with the development of the times, this system presents certain malpractices, resulting in endless violations in the project, such as bidders encircling bids, inviting bidders to avoid bidding, supervision departments, administrative departments, weak examination of bid evaluation experts, accepting bribes from others, and so on. The appearance of these violations disrupts the construction market of our country and brings extremely adverse influence to the stable development of the construction market. In view of these problems, the author starts from the violations in the project, first analyzes the manifestation of these violations, analyzes the harmfulness caused by the occurrence of these violations, and then uses the relevant principles of game theory, starting from the illegal behavior of bidders, the illegal behavior of bidders and supervisors, the behavior and cases of bidders and supervisors, and then thinks that the pursuit of economic interests is based on the relevant principles of game theory. The low cost of violations, the imperfection of relevant laws and the imperfection of supervision mechanism are the root causes of violations. Finally, the corresponding solutions are given. At the same time, under the system of principal-agent theory, the principal-agent relationship between different participants is analyzed, and the incentive mechanism, restraint mechanism and supervision mechanism are designed for bidding agent, bid evaluator and tenderer respectively. Finally, the shortcomings of supervision mechanism are summarized. According to these shortcomings, the specific strategies to improve the supervision mechanism are put forward to achieve the purpose of reducing violations. Of course, there are many shortcomings in this paper: 1 although this paper analyzes many kinds of violations, but does not carry on the more in-depth research to some specific links, is that some violations are not targeted in the process of description. 2 in the use of game theory, there is no in-depth research, at the same time, when using the relevant principles of game theory, we only describe the illegal behavior of string marking. There are no many kinds of violations to be studied, so that the conclusions are not targeted; (3) when using principal-agent theory, the mathematical model of mechanism design is not given from the point of view of economics, which is also the deficiency of the research process. (4) the research of supervision mechanism does not draw lessons from the foreign research on supervision mechanism.
