【摘要】：重整計(jì)劃強(qiáng)制批準(zhǔn)制度是企業(yè)重整中的核心問(wèn)題之一,是重整制度中的"核武器"。但是,作為一個(gè)舶來(lái)品,該制度在我國(guó)也面臨水土不服的問(wèn)題,在多個(gè)案例中,法院的強(qiáng)制批準(zhǔn)裁定都引發(fā)了學(xué)術(shù)界和實(shí)務(wù)界的廣泛質(zhì)疑。在重整計(jì)劃強(qiáng)制批準(zhǔn)制度在我國(guó)正式實(shí)施十周年之際,確有必要結(jié)合我國(guó)實(shí)際情況,對(duì)其進(jìn)行全方位的審視和評(píng)價(jià),通過(guò)修改強(qiáng)制批準(zhǔn)的審查標(biāo)準(zhǔn)、明確政府定位、提升司法公信力、完善程序設(shè)計(jì)等多方面措施,探尋該制度的未來(lái)發(fā)展方向。
[Abstract]:The compulsory approval system of reorganization plan is one of the core problems in the reorganization of enterprises, and it is the nuclear weapon in the reorganization system. However, as a foreign product, the system also faces the problem of disobedience in our country. In many cases, the compulsory approval decision of the court has aroused wide-ranging doubts in the academic and practical circles. On the occasion of the tenth anniversary of the formal implementation of the compulsory approval system of the reorganization plan in China, it is really necessary to examine and evaluate it in an all-round way in the light of the actual situation in China, and to clarify the position of the government by modifying the examination standard of the compulsory approval. To improve the judicial credibility, perfect the procedure design and other measures to explore the future development direction of the system.
