【摘要】：農(nóng)地"三權分置"改革從國家、集體、經(jīng)營者和農(nóng)民角度分別回應了土地制度變革的需求。相比較于其他農(nóng)地流轉方式,通過信托方式流轉農(nóng)地可以更好實現(xiàn)更新農(nóng)地經(jīng)營模式,確保農(nóng)民土地利益以及實現(xiàn)農(nóng)地保護制度等目標。當前,我們有必要梳理"三權分置"改革背景下土地信托的法律結構,從注重制度建設、完善土地信托的配套制度,并樹立信托法思維等角度完善土地信托制度。具體而言,政府可以通過在村集體組織內(nèi)設置專門的咨詢機構,為有意向參與土地信托流轉的農(nóng)戶提供咨詢服務,讓農(nóng)戶發(fā)現(xiàn)土地信托制度的優(yōu)點,進而運用該項制度。需要明確土地上各項權利的內(nèi)容,厘清權利的邊界。建立不動產(chǎn)信托登記制度,公示土地信托的信托財產(chǎn)和信托關系。為投資于農(nóng)地流轉信托所獲得的收益實行適當?shù)亩愂諆?yōu)惠,發(fā)揮信托的融資功能。
[Abstract]:From the angle of the state, the collective, the operator and the farmer, the reform of the "three separate rights" of the farmland responds to the demand of the reform of the land system respectively. Compared with other agricultural land transfer modes, the transfer of agricultural land by trust can better realize the goal of renewing farmland management mode, ensuring farmers' land benefit and realizing farmland protection system and so on. At present, it is necessary for us to sort out the legal structure of the land trust under the background of the reform of the "three rights separation", and to perfect the land trust system from the angle of paying attention to the system construction, perfecting the supporting system of the land trust, and setting up the trust law thinking and so on. Specifically, the government can provide consultation services to farmers who wish to participate in the transfer of land trust by setting up special advisory bodies in village collective organizations, so that farmers can discover the advantages of the land trust system, and then use the system. There is a need to clarify the content of the rights on the land and to clarify the boundaries of the rights. Establish the registration system of real estate trust, publicize the trust property and trust relationship of land trust. In order to invest in the transfer of agricultural land trust income from the implementation of appropriate tax concessions, play the role of trust financing.
