【摘要】：城市交通PPP模式是城市交通基礎(chǔ)設(shè)施建設(shè)的典型投資融資方式,其重點(diǎn)問題是平衡保護(hù)各方利益。透過城市交通PPP項(xiàng)目典型案例的觀察發(fā)現(xiàn),PPP項(xiàng)目失敗大多源自利益的失衡,而對社會(huì)資本利益保障的缺失是利益失衡的主要形態(tài),具體表現(xiàn)為對社會(huì)資本缺乏吸引力、缺乏對合理回報(bào)的保障、缺乏對公益保障的補(bǔ)償,法治現(xiàn)實(shí)中對社會(huì)資本利益訴求的歧視則是利益失衡的直接原因。為實(shí)現(xiàn)對各方利益的均衡保護(hù),需要正視社會(huì)資本利益訴求,基于維持社會(huì)資本相同經(jīng)濟(jì)地位理念,從鼓勵(lì)靈活多元的合作方式、構(gòu)建合理動(dòng)態(tài)的付費(fèi)機(jī)制、完善公益保障補(bǔ)償機(jī)制三個(gè)方向入手完善城市交通PPP模式的法治構(gòu)建。
[Abstract]:The PPP mode of urban traffic is a typical mode of investment and financing for urban transportation infrastructure construction. The key issue is to balance the interests of all parties. Through the observation of typical cases of urban traffic PPP project, it is found that the failure of PPP project mostly originates from the imbalance of interests, and the lack of interest protection of social capital is the main form of interest imbalance, which is manifested in the lack of attraction to social capital. The lack of reasonable return, the lack of compensation for public welfare, the discrimination against social capital interests in the reality of the rule of law is the direct cause of interest imbalance. In order to realize the balanced protection of the interests of all parties, it is necessary to face up to the demands of the interests of social capital. Based on the concept of maintaining the same economic status of social capital, a reasonable and dynamic payment mechanism should be constructed from encouraging flexible and diversified cooperation methods. Perfecting the compensation mechanism of public welfare security and perfecting the construction of urban traffic PPP model by law.
