【摘要】：家族信托受益人,是指依據(jù)家族信托行為而享有家族信托利益的人。家族信托受益人不是設(shè)立信托的行為人,僅具有抽象化的受益地位,是在信托關(guān)系中“純”享利益之人,具有被動性。受益人的特征以及其權(quán)益是一種有別于債權(quán)和物權(quán)的新型復(fù)合性權(quán)利。受益人的權(quán)益內(nèi)容包括知情權(quán)、決定權(quán)、撤銷權(quán)等。而且彼此之間一脈相承,知情權(quán)能讓受益人對受托人的事務(wù)管理、財(cái)產(chǎn)處分等行為了解的非常清楚,更好的決定受托人的去留以及是否需要受托人強(qiáng)制執(zhí)行家族信托。如果在了解家族信托處分事務(wù)的過程中,發(fā)現(xiàn)受托人有違背家族信托目的的行為,可以及時(shí)撤銷,使得家族信托財(cái)產(chǎn)恢復(fù)原狀,這不僅是受益人的一項(xiàng)權(quán)利,也是在受益人權(quán)益受到侵害后的一項(xiàng)事后救濟(jì)方式。在救濟(jì)方式上除了撤銷權(quán)外,受益人還能依靠委托人的權(quán)利保留以及通過家族信托簽訂時(shí)設(shè)置保護(hù)人或監(jiān)察人進(jìn)行事前預(yù)防。同時(shí),當(dāng)撤銷已經(jīng)不能彌補(bǔ)受益人的損失時(shí),還可以請求受托人恢復(fù)原狀以及損害賠償來進(jìn)行救濟(jì)。另外,由于受益人權(quán)益屬于一種財(cái)產(chǎn)性權(quán)益,自然也會經(jīng)歷取得、轉(zhuǎn)讓、放棄或終止的過程。委托人在與受托人磋商時(shí),可以為受益人設(shè)定一些義務(wù),如支付報(bào)酬、補(bǔ)償費(fèi)用、不得隨意干擾受托人執(zhí)行信托、保密義務(wù)、通知義務(wù)、尊重委托人以及其他受益人等等。受益人在進(jìn)行責(zé)任承擔(dān)時(shí),一般以其接受的家族信托財(cái)產(chǎn)及其收益為限,這是受益人責(zé)任有限性的體現(xiàn)。
[Abstract]:The beneficiary of family trust refers to the person who enjoys the benefit of family trust according to the behavior of family trust. The beneficiary of family trust is not the actor of establishing trust, only has the abstract beneficial status, is the person who enjoys the benefit in the trust relationship, and has the passivity. Beneficiary's characteristic and its rights and interests are a new compound right different from creditor's right and real right. The rights and interests of the beneficiary include the right to know, the right to make the decision, the right to revoke and so on. And the right to know can let the beneficiary understand the trustee's affairs management, disposition of property and so on very clearly, better decide the trustee's stay or not and whether need trustee to enforce the family trust. If, in the course of understanding the disposition of the family trust, it is found that the trustee has an act contrary to the purpose of the family trust, it can be revoked in time, so that the family trust property can be restored to its original state. This is not only a right of the beneficiary. It is also an ex post relief method after the beneficiary's rights and interests are infringed. Besides the right of rescission, the beneficiary can also rely on the right of the trustor to retain and the protector or supervisor to take precautions in advance when the family trust is signed. At the same time, when revocation can no longer make up for the beneficiary's loss, the trustee can also be asked to restitution and damages for relief. In addition, because the beneficiary's rights belong to a kind of property rights, they will go through the process of obtaining, transferring, abandoning or terminating. In consultation with the trustee, the trustor may set some obligations for the beneficiary, such as payment of remuneration, compensation, free interference with the trustee's execution of the trust, the duty of confidentiality, the obligation of notification, respect for the trustor and other beneficiaries, and so on. The beneficiary is usually limited to the family trust property and its income, which is the embodiment of the limited liability of the beneficiary.
