【摘要】：標準必要專利具有雙重屬性:一方面為激勵創(chuàng)新而具有私人獨占屬性,另一方面因納入標準而具有強烈的社會公共利益屬性。在社會分工不斷深化的背景下,標準必要專利的公共利益屬性日益凸顯。"FRAND原則"建立在專利權(quán)人本位立場之上,對專利權(quán)濫用的規(guī)制存在天然不足。標準必要專利許可費應(yīng)當采取分類規(guī)制原則,將"明顯低于正常許可費"作為基本目標,實現(xiàn)標準必要專利許可費厘定方法新的路徑。"高通案"對許可費的確定已經(jīng)體現(xiàn)出標準必要專利的公共利益屬性,但仍存在可以改進的空間。
[Abstract]:The essential patent of standard has double attributes: on the one hand, it has private exclusive attribute to encourage innovation, on the other hand, it has strong attribute of social public interest because it is included in the standard. Under the background of deepening social division of labor, the public interest attribute of standard essential patent is increasingly prominent. "FRAND principle" is based on the patentee standard, and the regulation of patent abuse is naturally inadequate. The standard essential patent license fee should adopt the classification regulation principle, take "obviously lower than the normal license fee" as the basic goal, realizes the standard essential patent license fee determination method new path. Qualcomm's determination of the license fee has reflected the public interest attribute of the standard necessary patent, but there is still room for improvement.
