交強險第三人直接請求權(quán)問題研究

【摘要】:保險是分散危險和消化損失的制度。交強險制度自實施以來,不僅促進了道路交通安全,而且分散了機動車駕駛?cè)说馁r償風(fēng)險,保障了交通事故受害人的合法權(quán)利。交強險第三人直接請求權(quán)作為實現(xiàn)這一立法目的的重要手段,在制度設(shè)計方面還太簡單,在受害第三人的范圍、索賠的權(quán)利等方面都存在一定疑問。本文從交強險第三人直接請求權(quán)的法理分析出發(fā),結(jié)合相關(guān)保險理論,以及我國交強險制度的現(xiàn)行法律規(guī)定和相關(guān)案例,并考察其他國家和地區(qū)的立法例,對交強險第三人直接請求權(quán)進行了探討,以期交強險第三人直接請求權(quán)能夠發(fā)揮其最大之功用,并使我國交強險制度更完善。除了引言和結(jié)論,本文分為以下四個部分:第一章為交強險第三人直接請求權(quán)的理論基礎(chǔ)。本章以交強險第三人直接請求權(quán)的界定為起點,從含義與起源剖析了該項權(quán)利的性質(zhì)和法理基礎(chǔ),并且闡述了該項制度的價值。第二章為我國的立法現(xiàn)狀及存在的問題。本章從我國現(xiàn)行交強險法條規(guī)范入手,對我國交強險第三人直接請求權(quán)制度的問題進行分析,并闡述了該權(quán)利缺失所產(chǎn)生之弊端,從而論述確立交強險第三人直接請求權(quán)的必要性。第三章為相關(guān)法律的比較法分析。本章介紹了英、德、法、美、日、臺等主要國家和地區(qū)的立法例,并總結(jié)分析了各自的特點,以期為完善我國相關(guān)法律提供借鑒。第四章為完善我國交強險第三人直接請求權(quán)的探討。本章通過以上三章的討論,提出完善交強險第三人直接請求權(quán)的具體建議。
[Abstract]:Insurance is a system for dispersing risks and digesting losses. Traffic insurance system has not only promoted road traffic safety, but also dispersed the risk of compensation for motor vehicle drivers since the implementation of the system, and ensured the legal rights of the victims of traffic accidents. As an important means to realize this legislative purpose, the direct claim right of the third party in traffic insurance is too simple in the system design, and there are some doubts in the scope of the third party who is injured and the right to claim for compensation. This article starts from the legal theory analysis of the direct claim right of the third party in traffic insurance, combined with the relevant insurance theory, the current legal provisions and relevant cases of our country's traffic compulsory insurance system, and investigates the legislation examples of other countries and regions. This paper probes into the direct claim right of the third party in traffic strong insurance, hoping that the direct claim right of the third party in traffic strong insurance can give play to its greatest function and make the system of traffic strong insurance in our country more perfect. In addition to the introduction and conclusion, this paper is divided into the following four parts: the first chapter is the theoretical basis of the third party's direct claim. This chapter starts with the definition of the right of direct claim of the third party in traffic compulsory insurance, analyzes the nature and legal basis of the right from the meaning and origin, and expounds the value of the system. The second chapter is the current situation of our legislation and the existing problems. This chapter analyzes the problems of the system of direct claim of the third party of traffic insurance in our country from the current regulations of traffic insurance law, and expounds the drawbacks of the lack of this right. The necessity of establishing the direct claim of the third party in traffic insurance is discussed. The third chapter is the comparative analysis of relevant laws. This chapter introduces the legislative examples of Britain, Germany, France, the United States, Japan, Taiwan and other major countries and regions, and summarizes and analyzes their characteristics, in order to provide reference for the improvement of relevant laws in China. Chapter four is to perfect the direct claim right of the third party of traffic insurance in our country. Through the discussion of the above three chapters, this chapter puts forward some concrete suggestions to perfect the direct claim right of the third party in traffic insurance.
