【摘要】：石油作為全球三大能源之一,是人類能源的重要支柱,由于其自身的稀缺性,決定了它天生的重要性。我國的石油資源并不豐富,隨著我國經(jīng)濟的迅速發(fā)展,石油資源的戰(zhàn)略地位愈發(fā)重要,國內(nèi)對石油的需求不斷增加,石油對外依存度越來越高,石油供需矛盾不斷加深,中國石油企業(yè)相繼“走出國門,放眼世界”。仔細(xì)研究我國企業(yè)石油海外投資的整個過程,我們不難發(fā)現(xiàn),法律風(fēng)險已經(jīng)滲透在整個過程之中,復(fù)雜多變的東道國法律環(huán)境以及勞工、環(huán)保等法律問題在眾多干擾因素中愈發(fā)的凸顯,導(dǎo)致了我國石油海外投資戰(zhàn)略受到了一定程度的影響。如何在未來石油海外投資活動中有效的防范應(yīng)對所遭受的法律風(fēng)險,是未來我國石油企業(yè)法務(wù)人員和法律顧問工作的重中之重。文章共分為五大部分,第一部分列舉了我國石油海外投資主要面臨的法律風(fēng)險有哪些；第二部分從三個角度較深的剖析了到底是什么原因使得我國石油海外投資活動遭遇了法律風(fēng)險；第三部分更深一步的探討了我們?yōu)槭裁匆獙κ秃Ｍ馔顿Y面臨的法律風(fēng)險進(jìn)行防控；第四部分思考化解我國石油海外投資法律風(fēng)險的防范措施,并對一些措施嘗試提出一些建設(shè)性的意見,為我國石油企業(yè)更好實現(xiàn)的“走出去”戰(zhàn)略目標(biāo)提供一定的理論支撐。
[Abstract]:As one of the three major energy sources in the world, petroleum is an important pillar of human energy. China is not rich in petroleum resources. With the rapid development of our economy, the strategic position of oil resources is becoming more and more important, the domestic demand for oil is increasing, the degree of dependence on oil is becoming higher and higher, and the contradiction between supply and demand of oil is deepening. Chinese oil enterprises have "gone abroad and looked around the world". Through a careful study of the whole process of overseas oil investment by Chinese enterprises, it is not difficult to find that legal risks have permeated the whole process, the complex and changeable legal environment of the host country and the labor force. Environmental protection and other legal issues have become increasingly prominent among many interfering factors, resulting in a certain degree of impact on China's petroleum overseas investment strategy. How to effectively prevent and deal with the legal risks in the future oil overseas investment activities is the most important task for the legal personnel and legal advisers of our petroleum enterprises in the future. The article is divided into five parts. The first part lists the legal risks that our country petroleum overseas investment faces; The second part deeply analyzes what causes the overseas investment of petroleum in China to encounter the legal risk from three angles. The third part further discusses why we should prevent and control the legal risk of overseas oil investment; In the fourth part, the author tries to put forward some constructive suggestions to resolve the legal risk of China's petroleum overseas investment, and provides some theoretical support for the better realization of the strategic goal of "going out" for Chinese petroleum enterprises.
