論3D打印運(yùn)動(dòng)鞋的知識(shí)產(chǎn)權(quán)保護(hù)

【摘要】:3D打印給運(yùn)動(dòng)鞋制造領(lǐng)域帶來(lái)了革命性的變化,但同時(shí)也使得新型運(yùn)動(dòng)鞋面臨各種被侵權(quán)的風(fēng)險(xiǎn)。在數(shù)字建模階段,制造商需要通過版權(quán)法保護(hù)其產(chǎn)品設(shè)計(jì)圖;在生產(chǎn)制造階段,制造商需要通過專利法、商標(biāo)法、反不正當(dāng)競(jìng)爭(zhēng)法來(lái)保護(hù)運(yùn)動(dòng)鞋中的技術(shù)方案、品牌標(biāo)識(shí)和裝潢花式。3D打印技術(shù)同時(shí)也使得消費(fèi)者很可能成為新的侵權(quán)者,這不但需要法律的相關(guān)調(diào)整,還需要制造企業(yè)提升自身的產(chǎn)品研發(fā)水平,從各種環(huán)節(jié)管控產(chǎn)品被仿造的風(fēng)險(xiǎn)。
