論中央與地方對行政事業(yè)性國有財產(chǎn)的分級所有

【摘要】:我國自建國以來一直將行政、事業(yè)單位所占有使用的財產(chǎn)視為國有。為便于管理,遂對其實行了中央與各級地方分級管理的體制,但各級地方對其直接管理的行政事業(yè)性財產(chǎn)往往享有了所有者利益而直接成為了利益主體,因此中央與地方之間勢必存在利益沖突。盡管適用我國國有財產(chǎn)的分級代表理論能夠在一定程度上緩解二者之間的利益沖突,但卻無法解決國有與各級地方實際處于所有者之間的矛盾,與其這樣,不如在借鑒中央與地方之間對國有財產(chǎn)分別享有權(quán)的分權(quán)理念下,直接賦予各級地方行政事業(yè)性財產(chǎn)所有權(quán)。即,中央直接占有使用的行政事業(yè)性財產(chǎn)應(yīng)為國有,各級地方直接占有使用的行政事業(yè)性財產(chǎn)應(yīng)為各級地方所有,典型的就是現(xiàn)實生活中大量存在的教育性財產(chǎn)也就相應(yīng)地被確定為國有與地方所有。
[Abstract]:Since the founding of the people's Republic of China, the property occupied and used by administrative and public institutions has been regarded as state-owned. In order to facilitate its management, the central and local governments have been put into practice the system of hierarchical management. However, the administrative property directly managed by the local authorities at all levels often enjoys the owner's interests and becomes the main body of interest directly. Therefore, there is bound to be a conflict of interest between the central and local governments. Although the theory of hierarchical representation of state-owned property in our country can alleviate the conflict of interest to some extent, it can not solve the contradiction between the state and the local owners at all levels. Under the concept of separation of rights between the central and local governments, it is better to directly endow the local administrative property at all levels with the ownership of the property. That is, the administrative property directly occupied and used by the central authorities shall be state-owned, and the administrative property directly occupied and used by the localities at all levels shall be owned by the localities at all levels. Typically, a large number of educational property in real life is determined to be owned by state-owned and local-owned property.
