【摘要】：農(nóng)業(yè)是經(jīng)濟(jì)發(fā)展的基礎(chǔ),是工業(yè)現(xiàn)代化的保障,對(duì)其進(jìn)行相應(yīng)的豁免已是各國的共識(shí)。我國《反壟斷法》第56條規(guī)定:"農(nóng)業(yè)生產(chǎn)者及農(nóng)村經(jīng)濟(jì)組織在農(nóng)產(chǎn)品生產(chǎn)、加工、銷售、運(yùn)輸、儲(chǔ)存等經(jīng)營(yíng)活動(dòng)中實(shí)施的聯(lián)合或者協(xié)同行為,不適用本法。"該法條是我國對(duì)農(nóng)業(yè)豁免的核心依據(jù),不僅規(guī)定了農(nóng)業(yè)豁免的主體,還對(duì)農(nóng)業(yè)經(jīng)營(yíng)的范圍和行為進(jìn)行了界定。但在適用過程中,此法條的農(nóng)業(yè)經(jīng)營(yíng)主體,農(nóng)業(yè)和農(nóng)產(chǎn)品的概念內(nèi)涵、外延不統(tǒng)一,這勢(shì)必會(huì)影響農(nóng)業(yè)豁免的順利實(shí)施。本文以56條為依據(jù),對(duì)主要爭(zhēng)議的問題進(jìn)行梳理,達(dá)到農(nóng)業(yè)豁免再認(rèn)知的目的。
[Abstract]:Agriculture is the foundation of economic development and the guarantee of industrial modernization. Article 56 of the Anti-monopoly Law of China states: "this Law shall not apply to joint or synergistic activities carried out by agricultural producers and rural economic organizations in the production, processing, marketing, transportation and storage of agricultural products." This article is the core basis of agricultural exemption in our country. It not only stipulates the subject of agricultural exemption, but also defines the scope and behavior of agricultural management. However, in the process of application, the agricultural management subject, the concept connotation and extension of agriculture and agricultural products are not unified, which will inevitably affect the smooth implementation of agricultural exemption. On the basis of 56 articles, this paper combs the main controversial issues to achieve the purpose of recognition of agricultural exemption.
