定期租船下船速索賠問(wèn)題研究

【摘要】:船速索賠是定期租船下特有的問(wèn)題,2000年英國(guó)期租解釋規(guī)則的出臺(tái)、NYPE2015格式范本第12條的亮點(diǎn)、以及英美判例的發(fā)展,都證明了船速索賠問(wèn)題在不斷發(fā)展,然而我國(guó)學(xué)界在此方面的研究卻比較零散,尚無(wú)全面、系統(tǒng)的闡釋船速索賠問(wèn)題的文章。筆者按照案件形成及處理的脈絡(luò)對(duì)文章進(jìn)行布局,在閱讀判例、仲裁裁決的基礎(chǔ)上,整合了各方面資料,針對(duì)定期租船下船速索賠問(wèn)題進(jìn)行細(xì)致、深入的研究和探討,具體如下:第一章闡釋了提出船速索賠的必備要素,包括存在船速保證條款、出租方違反船速保證條款兩個(gè)方面。結(jié)合NYPE格式范本和BALTIME格式范本,介紹了船速保證條款的存在形式,對(duì)于條款中的"滿載" "良好天氣" "平均""大約"等限定詞進(jìn)行學(xué)理分析及細(xì)化解釋。第二章歸納分析了出租方面對(duì)承租方提出的船速索賠享有哪些免責(zé)事由和抗辯事由,依據(jù)英國(guó)法和中國(guó)法相關(guān)規(guī)定進(jìn)行分析、比較,得出兩國(guó)法律雖然對(duì)免責(zé)和抗辯事由的用詞和界定方式不同,但其內(nèi)涵和外延是基本一致的。第三章解決了證據(jù)采信問(wèn)題,介紹了航海日志和氣象導(dǎo)航航次評(píng)價(jià)報(bào)告的優(yōu)缺點(diǎn),按照證據(jù)是否存在虛假性,劃分為一般做法與特殊做法,對(duì)比分析了中除法與英國(guó)法的相關(guān)規(guī)定和實(shí)踐做法。第四章分析索賠金額的計(jì)算,先分別闡釋傳統(tǒng)計(jì)算方式和氣導(dǎo)報(bào)告計(jì)算方式下船速索賠金額的計(jì)算方法,再探討燃油節(jié)約能否與船速索賠相抵沖,得出二者抵沖符合損益相抵原則和恢復(fù)原狀原則的結(jié)論,并分析了認(rèn)為不應(yīng)抵沖之觀點(diǎn)的缺陷所在,同時(shí)分析了燃油節(jié)約金額的計(jì)算方式。第五章是針對(duì)船速索賠相關(guān)問(wèn)題提出的建議,包括對(duì)于船速保證條款的形式和內(nèi)容的完善建議,以及對(duì)于我國(guó)船速索賠仲裁中仲裁員的專業(yè)性、簡(jiǎn)易程序的梯度性和臨時(shí)仲裁制度的引入三方面的完善建議。筆者在此文章中系統(tǒng)的闡釋了船速索賠相關(guān)問(wèn)題,以期填補(bǔ)此領(lǐng)域的空白,并為學(xué)界、司法界、律師界及租船實(shí)務(wù)界帶來(lái)便利。
[Abstract]:The claim for ship speed is a special problem under time chartering. The introduction of the British term charter interpretation rules in 2000 and the bright spot of article 12 of the NYPE2015 model format, as well as the development of British and American jurisprudence, all prove that the problem of ship speed claims is constantly developing. However, the research on this aspect in our country is rather scattered, and there is no comprehensive and systematic explanation of the problem of ship speed claim. According to the formation and processing of the case, the author makes a layout of the article. On the basis of reading the case and the arbitration award, he integrates all aspects of the data and makes a detailed and in-depth study and discussion on the issue of the time chartered ship speed claim. The main contents are as follows: the first chapter explains the essential elements of the ship speed claim, including the existence of the ship speed guarantee clause and the breach of the ship speed guarantee clause by the lessor. Combined with NYPE format and BALTIME format model, this paper introduces the existing form of ship speed guarantee clause, and makes a theoretical analysis and detailed explanation of the terms of "full load", "good weather" and "average" approximately. In the second chapter, the author summarizes and analyzes the reasons of exemption and defense for the lessee's claim for ship speed, and compares it with the relevant provisions of British law and Chinese law. It is concluded that although the terms and definitions of exemption and defense are different between the two countries, their connotations and denotations are basically the same. The third chapter solves the problem of evidence adoption, introduces the advantages and disadvantages of log books and weather navigation voyage evaluation reports, and divides them into general practice and special practice according to whether the evidence is false or not. This paper contrasts and analyzes the relevant provisions and practice of Chinese division and English law. The fourth chapter analyzes the calculation of claim amount, first explains the calculation method of the claim amount of ship speed under the traditional calculation method and the calculation method of gas conduction report, then discusses whether the fuel economy can offset the ship speed claim. A conclusion is drawn that both of them are in line with the principle of profit and loss offset and the principle of restitution, and the defects of the viewpoint that should not be offset are analyzed, and the calculation method of fuel saving amount is analyzed at the same time. The fifth chapter is about the suggestions of the ship speed claim, including the form and content of the ship speed guarantee clause, and the arbitrators' professionalism in the arbitration of the ship speed claim in our country. The gradient of summary procedure and the introduction of temporary arbitration system. In this paper, the author systematically explains the problems related to the ship speed claim, in order to fill the gap in this field, and bring convenience to the academic, judicial, legal and chartering practice circles.
