【摘要】：隨著我國經濟快速發(fā)展,正規(guī)金融機構已逐漸無法滿足中小企業(yè)對資金的強烈需求,導致很多企業(yè)被迫將融資方式轉入目前制度不夠完善的民間借貸,由于目前國內民間借貸尚且缺乏一部系統(tǒng)完備的立法,引發(fā)許多值得關注的法律與社會問題,而香港當局出臺的相關立法較為有效的規(guī)制了其借貸活動,對于香港完善以及規(guī)范借貸市場的有效經驗值得我們予以學習和借鑒,用以在我們目前極具有爭議的自然人職業(yè)經營放貸、提高借貸利率上限、民間借貸罪與非罪法律界限和民間借貸監(jiān)管制度這些問題上找到解決方案。
[Abstract]:With the rapid economic development of our country, formal financial institutions have been unable to meet the strong demand for funds of small and medium-sized enterprises. As a result, many enterprises have been forced to transfer their financing methods to non-government loans with imperfect systems. At present, the lack of a systematic and complete legislation on private lending in China has caused many legal and social problems worthy of attention, and the relevant legislation issued by the Hong Kong authorities has effectively regulated its lending activities. The effective experience of perfecting and regulating the lending market in Hong Kong is worthy of our learning and learning. It can be used to lend in our currently highly controversial natural person profession and to raise the ceiling on lending rates. The legal boundary between non-criminal and non-criminal law and the supervision system of non-criminal lending should be solved.
