【摘要】：海關(guān)監(jiān)管以物為對象,不考慮相對人的因素。圍繞私貨的處置,我國立法機關(guān)賦予了海關(guān)一些特別的職權(quán)。海關(guān)法特殊規(guī)定及其實施涉及對某些基本權(quán)利的限制或剝奪,因此,相應(yīng)處置過程所需要解決的基本問題,是公權(quán)力所代表的國家利益與私人利益之間的沖突。海關(guān)應(yīng)以職權(quán)法定、保障公民私有財產(chǎn)權(quán)和比例原則等憲法原則和精神為基準(zhǔn),對實施海關(guān)法特殊規(guī)定的行為做合憲性考量。
[Abstract]:Customs supervision takes object as the object, does not consider the relative person's factor. Around the disposal of private goods, China's legislature has given customs some special powers. The special provisions of the Customs Law and its implementation involve the restriction or deprivation of some basic rights. Therefore, the basic problem to be solved in the process of corresponding disposal is the conflict between the national interests and the private interests represented by the public power. Based on the constitutional principles and spirit, such as the statutory functions and powers, the protection of citizens' private property rights and the principle of proportionality, the Customs shall make constitutional considerations on the implementation of the special provisions of the Customs Law.
