光船租賃登記法律問題研究

【摘要】:光船租賃登記問題產(chǎn)生于光船租賃這一法律行為,雖然光船租賃在世界航運(yùn)史上產(chǎn)生較早發(fā)展較快,但是到目前為止關(guān)于光船租賃登記的問題國(guó)際上仍然沒有統(tǒng)一的規(guī)定發(fā)展緩慢,盡管早年間制定過相關(guān)的統(tǒng)一立法致力于把光船租賃登記問題標(biāo)準(zhǔn)化但是現(xiàn)在已形同虛設(shè)。光船租賃登記問題現(xiàn)由各國(guó)的國(guó)內(nèi)法予以規(guī)定,但是各國(guó)的國(guó)內(nèi)法規(guī)定的各不相同,有的國(guó)家甚至沒有光船租賃登記的規(guī)定或者不要求進(jìn)行登記,這對(duì)于中國(guó)光船租賃登記的發(fā)展在借鑒國(guó)外立法經(jīng)驗(yàn)上造成了一定的限制。本文是圍繞光船租賃登記進(jìn)行展開論述,對(duì)光船租賃登記進(jìn)行立法和司法實(shí)踐中的現(xiàn)狀和問題進(jìn)行一定的梳理。首先,對(duì)光船租賃登記進(jìn)行了整體上的概述,從宏觀上界定光船租賃登記包括光船租賃登記的定義、性質(zhì)和它的法律效力以及登記效力的時(shí)間范圍,從體系上和比較的方法整理了有關(guān)光船租賃登記的法律依據(jù),從而清晰地看出中國(guó)立法與外國(guó)立法在光船租賃登記上的相同點(diǎn)與差異,對(duì)于中國(guó)光船租賃要進(jìn)行登記的必要性也在這一部分進(jìn)行了相關(guān)闡述意在對(duì)中國(guó)光船租賃的登記的發(fā)展完善進(jìn)行基礎(chǔ)上的鋪墊。其次,通過插入案例的形式形象地介紹在中國(guó)光船租賃登記的海事實(shí)踐中存在的相關(guān)問題,即登記與否對(duì)于相關(guān)行為人和有關(guān)法律事實(shí)后果的影響,但本編文章對(duì)于在案例中存在的問題主要集中敘述了三個(gè)方面分別是登記與否對(duì)船員行為的后果是否具有影響、對(duì)于船舶碰撞責(zé)任的承擔(dān)是否具有影響、對(duì)于船舶的風(fēng)險(xiǎn)和碰撞責(zé)任之外的船舶責(zé)任的影響。再次,對(duì)于光船租賃登記問題各個(gè)國(guó)家有不同的法律規(guī)定,由于它很難進(jìn)行國(guó)際統(tǒng)一的立法也沒有達(dá)成一致的國(guó)際條約或相關(guān)協(xié)議,只有各國(guó)家在立法上的不同規(guī)定甚至沒有規(guī)定盡管這樣也可以從有限的資源中汲取對(duì)自身發(fā)展有益的內(nèi)容。最后,對(duì)中國(guó)光船租賃登記的立法現(xiàn)狀及完善進(jìn)行論述,一方面分析了中國(guó)立法中對(duì)于光船租賃登記問題的規(guī)定,包括法律趨于完整的發(fā)展歷程,主要集中在不同性質(zhì)和位階中法律規(guī)定的不同,然后是中國(guó)光船租賃登記制度中存在的相關(guān)不足之處和立法中的不完善不協(xié)調(diào)不統(tǒng)一之處,最后一部分對(duì)中國(guó)光船租賃登記制度存在的問題提出相關(guān)完善的意見,包括制度、立法和程序上的幾點(diǎn)意見。本篇文章主要是圍繞光船租賃登記的問題進(jìn)行相關(guān)的闡述,通過從整體上介紹光船租賃登記的相關(guān)概述及發(fā)展情況,從國(guó)際法的角度引入國(guó)外立法和實(shí)踐中的相關(guān)經(jīng)驗(yàn),以期對(duì)中國(guó)光船租賃登記問題有一定的參考價(jià)值和意義。
[Abstract]:The problem of bareboat charter registration arises from the legal act of bareboat charter, although bareboat charter has developed earlier in the world shipping history. However, up to now, there is still no uniform regulation on bareboat charter registration in the world. Although the relevant uniform legislation was made in the early years to standardize the bareboat charter registration problem, it is now virtually empty. The issue of bareboat charter registration is now regulated by the domestic laws of each country, but the domestic laws of each country are different, and some countries do not even have provisions for bareboat charter registration or do not require registration. This limits the development of bareboat charter registration in China. This paper discusses the registration of bareboat charter and sorts out the current situation and problems in legislation and judicial practice of bareboat charter registration. First of all, a general overview of bareboat charter registration is given. From a macro perspective, the definition, nature, legal effect and time range of bareboat charter registration including bareboat charter registration are defined. The legal basis of bareboat charter registration is sorted out in terms of system and comparative method, and the similarities and differences between Chinese legislation and foreign legislation in bareboat charter registration are clearly seen. The necessity of registration of bareboat charters in China is also discussed in this part, which is intended to lay a foundation for the development and perfection of the registration of bareboat charters in China. Secondly, the paper introduces the related problems in the maritime practice of bareboat charter registration in China by inserting cases, that is, the influence of registration on the relevant actors and legal factual consequences. However, this article focuses on three aspects: whether registration or not has an impact on the consequences of crew behavior, and whether it has an impact on the liability for ship collision. Impact on ship's risk and liability other than collision liability. Thirdly, there are different legal provisions on bareboat charter registration in different countries, because it is very difficult for it to carry out internationally uniform legislation and there is no agreed international treaty or related agreement. Only countries have different legislative provisions that do not even provide for the benefit of their own development from limited resources. In the end, the paper discusses the legislation status and perfection of bareboat charter registration in China. On the one hand, it analyzes the regulation of bareboat charter registration in Chinese legislation, including the complete development course of the law. Mainly concentrated in the different nature and rank of the different legal provisions, and then there are some deficiencies in China's bareboat charter registration system and the legislation in the imperfect incongruity and disunity, In the last part, the author puts forward some suggestions on the problems existing in China's bareboat charter registration system, including the system, legislation and procedure. This article mainly focuses on the issue of bareboat charter registration, through the overall introduction of bareboat charter registration related overview and development, from the perspective of international law to introduce foreign legislation and practice of relevant experience, In order to China bareboat charter registration has certain reference value and significance.
