【摘要】：政府臨時價格干預是在市場機制無法正常發(fā)揮作用時對市場價格的管制。在市場價格總水平出現(xiàn)劇烈波動、嚴重自然災害、突發(fā)公共事件、通貨膨脹等特殊時期,部分經(jīng)營者哄抬物價、囤積居奇、謀取暴利,市場價格被極大程度的扭曲,阻礙市場經(jīng)濟的發(fā)展。政府作為國家行政機關,就需要為保障市場良好運行、維護社會穩(wěn)定等目的對市場價格進行暫時性的、適當、謹慎的干預。本文從國家干預市場的理論基礎和界限入手,分析得出在市場失靈情況下政府基于公共利益應當對市場進行干預,并且要受到干預成本、干預能力、干預程序、干預范圍的限制。其次,對臨時價格干預的法律性質和原則進行分析,政府的干預是必要的、臨時的、局限的干預。我國的臨時價格干預在非典型肺炎、汶川地震、南方雪災等突發(fā)事件中都發(fā)揮過良好作用,但是在立法和實踐中也存在著諸多問題。通過對我國臨時價格干預立法和實踐進行分析,提出完善立法和執(zhí)法的建議,并主張不僅要通過法律手段治理價格亂象,也要充分發(fā)揮行業(yè)規(guī)則和道德對價格行為的引導和規(guī)范。針對臨時價格干預作用的強制性和局限性,提出以加強重要商品儲備、健全價格監(jiān)測、完善價格調節(jié)基金以及推進價格預警立法等良性方式保障供應、穩(wěn)定物價的建議。
[Abstract]:Government temporary price intervention is the control of market price when the market mechanism is unable to function properly. In special periods such as severe fluctuations in the total market price level, serious natural disasters, public emergencies, inflation, and other special periods, some operators bid up prices, hoarded and made huge profits, and market prices were distorted to a great extent. Hinder the development of market economy. The government, as a state administrative organ, needs to intervene in the market price temporarily, appropriately and prudently for the purpose of ensuring the good operation of the market and maintaining social stability. Starting with the theoretical basis and limits of state intervention in the market, this paper concludes that the government should intervene in the market on the basis of the public interest under the situation of market failure, and be subject to the intervention cost, ability and procedure of intervention. Restrictions on the scope of intervention Secondly, analyzing the legal nature and principle of temporary price intervention, the government intervention is necessary, temporary and limited. China's temporary price intervention has played a good role in atypical pneumonia, Wenchuan earthquake, southern snow disaster and other emergencies, but there are also many problems in legislation and practice. Through the analysis of the legislation and practice of temporary price intervention in our country, the author puts forward some suggestions on how to perfect the legislation and law enforcement, and advocates that we should not only control the price disorder through legal means. Also should give full play to the industry rules and ethics of price behavior guidance and regulation. In view of the compulsion and limitation of temporary price intervention, suggestions are put forward to strengthen the important commodity reserve, perfect the price monitoring, perfect the price regulation fund and push forward the price warning legislation to ensure the supply and stabilize the price.
